HomeMy WebLinkAbout071-84 BEFORE THE CITY COUNCIL OF THE CITY OF DANVILLE Certifying the Final Environmental ) Impac~ Report for the Danville Inn ) RESOLUTION NO. 71-84 General Plan Amendment (File No. ) GPA 83-2) ) ) RESOLVED by the City Council of the City of Danville as follows: The applicant, La Jolla Development Company, re- quested a General Plan Amendment to allow it to construct a 108 unit Inn on 2.945 acres located on the south side of Sycamore Valley Road West, west of its intersection with San Ramon Valley Boulevard (Assessor's Parcel No. 208-462-12) The subject parcel is part of the Sycamore Valley Road Specific Plan area. A Specific Plan Amendmentswas adopted July 10, 1979 designating this parcel as low density multiple family residential. It was rezoned to P1 by Contra Costa County on September 18, 1979, ('County file No. 2120-RZ) and was desig- nated in the preliminary development plan approved on the same date for the specific plan amendment area as multiple family residential low density. On June 24, 1980, a final development plan for the specific plan amendment area was approved providing for the con- struction of 25 condominium residential units (Contra Costa County File No. DP3083-79). A final map for the subdivision of the subject parcel the 25 condominium lots was approved on December 22, 1981 (Subdivision NO. 6131) . The applicant filed a request for general plan amendment from multiple family use to commercial use on March 31, 1983 for the purpose of amending the final development plan (DP 3083-79) to permit the construction of an inn or lodging facility. The County Planning Department, acting on behalf of the City, made an initial study of environmental signifi- cance dated May 19, 1983 and determined that the application for the general plan amendment required the preparation of an environmental impact report under CEQA. The City had a draft environmental impact report prepared by the firm of Wagstaff and Brady. On April 27 ,1984, a notice of completion was filed with the Secretary of Resources. Public notice of the availability of the draft EIR was given in the manner r~ired by law and copies of the draft EIR were made available to the public beginning ~[4arch 23 ,1984. The time for written comments from the public and interested agencies was provided up through April 23, 1984 and then extended to April 27, 1984. After the giving of notice the Planning Commission conducted a public hearing on the draft EIR on May 14, 1984. After receiving oral public comments, the Planning Commission closed the public hearing, allowed for additional written comments through the close of business on May 18, 1984 and directed Wagstaff and Brady to prepare re- sponses to written and oral comments. --2-- The Planning Commission reviewed the final EIR comprising the draft EIR, the written and oral comments and the responses thereto, on May 31, 1984. On May 31, 1984, the Planning Commission recom- ~mended that the City Council certify the final EIR. The City Council has examined, reviewed and studied the final EIR. NOW THEREFORE the City Council of the City of Danville finds and determines as follows: 1. The draft EIR together with comments, re- sponses to comments, the statement of findings and miti- gation measures and the list of persons, organizations and public agencies commenting on the draft EIR attached to this resolution as Exhibit "A" constitute the final EIR for the purpose of amending the General Plan; 2. Adequate time and opportunity has been available to other public agencies and members of the public to review and ¢o~uent on':-'%he E:~R~':.: :, . 3. The final EIR has been completed with a sufficient degree of analysis to provide the City Council with information which enables it to make a decision which intelligently takes account of environmental consequences; 4. The final EIR is adequate and has been completed in compliance with CEQA, the State Guidelines, the City's processing procedures and other requirements imposed by -3- law.
