RESOLUTION NO. 27~84
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANVILLE
In support of Residential Time-of-Use Electrical Rates
WHEREAS, twenty thousand families are saving an average of $20 per month
by participating in PGandE's Residential Time of Use Rate Programl
WHEREAS, these families are also contributing to the reduction of peak
load demand, the most expensive form of electricity, by shifting their
electrical use during the peak hours from an average of 20% on peak to
13% on peak;
WHEREAS, the Public Utilities Commission held extensive hearing over a
nine month period to evaluate the effectiveness of TOU Rates;
WHEREAS, the Administrative Law Judge who presided ove~ these hearings
concluded with a decision that was very supportive of Time~of~Use Rates,
including:
1. Authorization of 20,000 to 25,000 new participants each year
until 1986.
2. Adoption of a specific rate structure, LGC-10.
3. Adoption of specific goals and evaluation criteria for con-
tinued analysis of the program;
WHEREAS, the Public Utilities Commissioners then reversed the decision of
the presiding Judge in a move detrimental to the future expansion of the
program with the following decision:
1. Authorization of 2,500 new meters each year until 1986;
2. Adoption of an unspecified "revenue neutral" rate structure;
3. No articulation of specific program goals or evaluation
criterla~
4. Direction to PGandE to perform further experimentation on the
rate structure;
5. Setting May 16, 1984 as the effective date of the new rate
structure;

WHEREAS, the Public Utilities Commission's decision ignores evidence in
the record on the availability of existing TOU rate experiments, thus
forcing duplication of existing efforts;
WHEREAS, the allocation five thousand meters over the next two years is
inadequate to meet the existing demand since almost two thousand families
are already on the waiting list;
WHEREAS, if the experiment proceeds as planned it will be difficult to
assess the success of it without any evaluation criteria or program goals;
WHEREAS, timing of the effective date of the unspecified rate structure
makes it difficult for existing TOU participants to decide whether or
not to continue on the program;
WHEREAS, the decision completely ignores the needs of electric water
heating customers who will be receiving bill increases far in excess
of all other customers and whose electrical appliances make them
especially suitable for Time-of-Use Rates;
WHEREAS, this decision of the Public Utilities Commission on Residential
Time-Of-Use Rates is neither equitable nor in the best interest of the
citizens of the City of Danville/ County of Contra Costa;
NOW THEREFORE BE IT RESOLVED that the City of Danville/ County of
Contra Costa hereby petitions the Public Utilities Commission to re-
consider their decision on Residential Time-Of-Use Rates and urges
them not to ignore the results of many months of hearings.
