HomeMy WebLinkAbout071-83 DANVLLE Town of Danville 315 Diablo Road, Suite 111 Danville, CA 94526 (415) 820-6337 RESOLUTION NO. 71-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANVILLE Intention to Adopt Resolution of Necessity to Acquire Real Property by Eminent Domain The City Council of Danville RESOLVES THAT: It intends to Adopt a Resolution of Necessity for the acquisition by eminent domain of real property at the intersection of Diablo Road and Green Valley Rd., for the Green Valley Rd. Safety Path, a public improvement, which property is more particularly described in Appendix "A" attached hereto. This Council will meet on August 15, 1983, at 7:30 p.m. in the Ed Center Building, Danville, California, to hear those persons whose property is to be acquired and whose names and addresses appear on the last equalized County assessment roll, and to consider the adoption of the Resolution. The staff is DIRECTED to send the fol- lowing notice to each such person by first-class mail: NOTICE oF INTENTION TO ADOPT RESOLUTION OF NECESSITY The City Council of Danville declares its intention to adopt a Resolution of Necessity for the acquisition of eminent domain of real property at the intersection of Green Valley Rd. and Diablo Rd. for the Green Valley Rd. Safety Path, a public improvement, which property is more particularly described in Appendix "A" attached hereto. The Council will meet on August 15, 1983, at 7:30 p.m. in the Ed Center, 699 Old Orchard Rd., Danville, California, to consider the adoption of the Resolution. Each person whose property is to be acquired and whose name and address appears on the last equalized County assessment roll has the right to appear at such hearing and be heard on: 1. Whether the public interest and necessity require the project; and 2. Whether the project is planned and located in the manner that will be most compatible and with the greatest public /-- good and the least private injury; and Resolution N. 71-83 3. Whether the property sought to be acquired is necessary for the project. 4. Whether the offer of just compensation required by Section 7267.2 ofthe Government Code has been made to the owner of record. Williams and Diane H. Williams, his wife, recorded August 27, 1982, in Book 10908 at page 526 of Official Records of Contra Costa County, California, described as follows: Beginning on the northerly line of the said Williams Parcel at the westerly right of way line of Green Valley Road as said existing right of way line is shown on the map entitled "A Precise Section of the Streets and Highways Plan-Contra Costa County-Precise Align- ment-Diablo Road" recorded July 18, 1966, in Book 5163 at page 195 of Official Records of said County; thence from said points of beginning along the said northerly line, North 73° 30'04" West 5.16 feet to a point on a line parallel with and 5.00 feet westerly,right angle measure, from said existing westerly right of way line (5163 OR 195); thence along said parallel line, South 1°59'48" West 2.01 feet; thence southwesterly along the arc of a tangent curve, concave to the northwest having a radius of 60.00 feet through a central angle of 50011'34", a distance of 52.56 feet; thence along the prolon- gation of the radial line through the end of said curve south 37° 48' 38" East 1.32 feet to the existing northwesterly right of way line of Diablo Road as shown on said map (5163 OR 195); thence along the said right of way line, north 48°06'41" East 35.71 feet to the said existing westerly right of way line of Green Valley Road (5163 OR 195); thence along said westerly line, North 1°59'48" East 23.07 feet to the point of beginning. Containing an area of 249 square feet of land more or less. Bearings and distances used in the above description are based on the California Coordinate System Zone III. To obtain ground distance mul- tiply distances use by 1.0000888.
