HomeMy WebLinkAbout057-83 DANVLLE Town of Danville 542 San Ramon Valley Boulevard Danville, CA 94526 (415) 820-6337 RESOLUTION NO. 57-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANVILLE ESTABLISHING A REINSPECTION FEE FOR THE ENFORCEMENT OF SOLID WASTE STANDARDS WHEREAS, the Health Services Department of Contra Costa County is the designated Local Enforcement Agency (Government Code Section 66796) for health related solid waste standards within the City and is required by Government Code Section 66796.10 to enforce the provisions of Chapter 3 (commencing with Section 66795) of Title 7.3 of the Government Code and the regulations adopted thereunder, and the regulations adopted under Government Code Section 66770 pertaining to the minimum standards for solid waste handling and disposal for the protection of air, water, and land from pollution or nuisance and for the protection of the public health; and WHEREAS, the expenses incurred by the Health Services Department in fulfilling these required enforcement activities are not met by any fees prescribed by'the State or currently being collected by the City, and a significant portion of its costs is due to repeated inspections of properties not in compliance with the applicable State and City standards; and WHEREAS, Health and Safety Code Section 510 provides for the imposition of fees by resolution in the circumstances described above: NOW, THEREFORE, The City Council of the City of Danville resolves: 1. That a reinspection fee, in an amount set by the Board of Supervisors from time to time, shall be imposed by the Health Services Department when an owner or occupant after being issued a Notice to Abate fails to comply with the Notice to Abate within the period specified therein, being allowed at least ten (10) days after issuance of the Notice to Abate the subject violations. 2. That a copy of this resolution be sent to the Health Services Department of the County of Contra Costa. PASSED, APPROVED AND ADOPTED this 6th day of June, 1983, by the following vote: AYES: Lane, May, Mc Neely, Offenhartz and Schlendorf NOES: None ABSENT: None RESOLUTION NO. 57-83 City C le~r~~
