RESOLUTION NO. 47'83
A RESOLUTION OF THE CITY OF DANVILLE
ESTABLISHING PERSONNEL POLICY GUIDELINES
WHEREAS, the City Council of the City of Danville desires to implement
fair and equitable personnel management policies for its employees; and
~EREAS, the City Manager has developed personnel policy guidelines
which are incorporated herein;
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
DANVILLE DOES HEREBY ADOPT THE PERSONNEL POLICY GUIDELINES LISTED BELOW:
Section 1. Adoption Of PersOnnel system: The purpose of these guidelines
is to establish a system of personnel administration based on merit principles.
These merit principles include:
(a) Recruiting, selecting, and advancing employees on their
relative abilities, knowledges, and skills;
(b) Providing equitable and competitive compensation;
(c) Training employees as needed, to assure high quality
performance;
(d) Retaining employees on the basis of the adequacy of their
performance, and separating employees whose inadequate
performance cannot be corrected;
(e) Assuring the impartial treatment of applicants and
employees in all aspects of personnel administration
without regard to political affiliation, race, color,
national origin, sex, religion, age, marital status, or
handicap, and with proper regard for their privacy and
constitutional rights as citizens.
Section 2. Personnel O{{icer: The Council Manager Ordinance designates
the City Manager as the Personnel Officer. The City Manager may delegate for
administrative purposes any of the powers and duties conferred upon him/her as
Personnel Officer to any other officer or employee of the City. The Personnel
Officer shall:
(a) Administer all personnel policies established in this
resolution, or as otherwise adopted by the City Council.
(b) Prepare and implement personnel rules and revisions and
amendments to such rules as necessary for the efficient
operation of the City Government organization.
(c) Prepare or cause to be prepared a position classification
plan, including class specifications, and revisions of
the plan. At a minimum the classification plan will
include an appropriate job related title for each class,
describe representative duties of the work to be assigned
to each class, and identified knowledge, skill, and ability
requirements for those employees assigned to perform the
work.
(d) Prepare or cause to be prepared an employee compensation
plan including base salary and fringe benefits provisions.
The plan, and any revisions thereof, shall become effective
upon approval by the City Council.
(e) Appoint, provide for the training, motivation, and evaluation
of, and dismiss employees. Such authority may, at the
discretion of the Manager, be delegated in whole or in part,
to other employees or officers of the City in the interest
of promoting management and supervisory accountability and
~,, responsibility.
(f) Establish positions and provide for the assignment of specific
duties and responsibilities to employees. The number of
positions shall be subject to the funding appropriation
authority of the City Council.
(g) Provide for the recruitment and selection of qualified
employees and the assignment of positions to an appropriate
classification of work.
(h) Provide for the hearing of appeals submitted by any applicable
employee relative to any disciplinary action, dismissal,
demotion, interpretation, or alleged violation of these
policies or the Personnel Rules and to make findings and final
disposition of such appeals.
(i) Investigate and make recommendations to the City Council as may
by appropriate on any matter of personnel policy.
(j) Conduct, administer or otherwise carryout all labor relations'
activities on behalf of the City.
Section 3. Scope: The provisions of these policies shall apply to all
offices. positions and employees in the service of the City, except:
(a) Elective officers.
(b) Members of appointive boards, commissions, and committees.
(c) The City Manager and City Attorney
(d) Volunteer and temporary personnel.
Section 4. Adoption And Amendment Of Rules And Procedures: Personnel
rules and procedures shall be developed by the Personnel Officer. The Personnel
Officer shall give reasonable written notice to each employee affected by such
rules and procedures including amendments thereto. Such rules and procedures
shall contain administrative policies and procedures governing the Personnel
System including:
(a) Preparation, installation, revision, and maintenance of a
position classification plan covering all positions
including employment standards and qualifications for
each class.
(b) Preparation, recommendation to the City Council for
approval, implementation, revision, and maintenance of
an employee compensation plan(s) including salary and
fringe benefit provisions. Compensation policies, including
revisions, for applicable employees shall be effective only
upon approval of the City Council.
(c) Acceptance and evaluation of applications for employment.
(d) Evaluation of employee performance for retention and other
purposes.
(e) Transfer, promotion, demotion, reinstatement, disciplinary
action and layoff of employees.
(f) Separation of employees from the City service.
(g) The establishment and maintenance of adequate personnel
records.
(h) The establishment of appeal procedures concerning the
interpretation and application of this resolution and any
rules and procedures adopted hereunder.
(i) Procedures necessary to comply with state and federal laws
governing public employees.
(j) Any other matter relating to personnel matters.
Section 5. Improper Political Activity: The political activities of
City employees shall conform to pertinent provisions of state law.
