Code Section 8335) In the Matter of Vacation of a Portion of West E1 Pintado Right of Way Vacation No. 1903 The City Council of the City of Danville RESOLVES THAT: This vacation is made pursuant to Streets and Highways Code Section 8334. The subject right of way is located approximately 3,000 feet north of the West E1 Pintado/Diablo Road intersection and is opposite Valley Creek Lane. This right of way is part of the right of way deeded to Contra Costa County in 1920 for roadway purposes. The road built within this right of way was accepted by Contra Costa County and named West E1 Pintado. The alignment Of West E1 Pintado was later changed after additional right of way was granted to Contra Costa County. This new alignment also included widening of the road to its ultimate width (40 feet of pavement within a 60-foot right of way). With West E1 Pintado being at its ultimate width, the subject right of way is excess and can therefore be vacated. For a description of the Pontion to be vacated, see Exhibits "A" and "B" attached hereto and incorporated herein by this reference. As this right of way is now located in the recently incorporated City of Danville, the Danville City Council will have to approve the vacation. This Council hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be categorically except under State guidelines Section 15112 in compliance with the California Environmental Quality Act. The land is not located in an area of statewide interest or potential area of critical concern. This Council declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes a highway. This vacation is made under the Streets and Highways Code, Chapter 4, Sections 8330 et seq. The land being vacated is excess street right of way not required for street purposes. ,~ .... ?& . .= The Public Works Director shall file with the County Clerk a Notice of Exemption concerning this vacation. A certified copy of this resolution, attested by the City Clerk under seal, shall be recorded in the office of the Recorder of the County of Contra Costa within which the City of Danville is located. Vacation No. ~ EXHIBIT "A" A portion of the countv road known as West E1 Pintado described in deed to Contra Costa County recorded December 21, 1920 in Book 370 of Deeds at page 475, records of Contra Costa County, California, described as follows: Commencing on the westerly right of way line of said West E1 Pintado ~50.00 feet in right of way widthl at the northeasterly corner of Lot D as said lot is shown on the map of First Addition of Rancho E1 Rio filed January 4, 19!1 in Book 4 of maps at page 78, records of said County; thence, from said point of commencement along the said westerly line, south 0° 11' 14" east 72.87 feet (the bearing south 0o 11' 14" east is taken for the purpose of this description) to the point of beginning; thence, continuing alonq said westerly line, south 0o !1' 14" east 149.84 feet; thence, leavinq said line, north 78o 05' 26" east 7.70 feet to a point from which a radial line of a curve concave ~to the southeast having a radius of 29.50 feet bears north 74o 16' 21" east; thence northeasterly along said curve, through a central angle of 80o 42' 38", an arc distance of 4!.56 feet; thence north 11o 54' 34" west 116.02 feet to the point of beginning.
