HomeMy WebLinkAbout057-82 DANV LE Town of Danville 315 Diablo Road, Suite 111 Danville, CA 94526 (415) 820~6337 RESOLUTION 57 -82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANVILLE APPOINTING CITY MANAGER, CLERK AND TREASURER WHEREAS, the City Council has made an offer of employment as City Manager to Michael M. Davis according to terms of employment set forth in a letter of agreement, dated November 24, 1982, which is attached to and made a part of this resolu- tion; and WHEREAS, Mr. Davis has accepted the offer of employment; and WHEREAS, Section 2-207 of the Ordinance Code of the City of Danville requires the City Manager to perform the duties of City Clerk and carry out such other responsibilities which may be assigned by the City Council; NOW, THEREFORE, BE IT RESOLVED, that Michael M. Davis is appointed City Manager effective December 13, 1982, according to the terms of employment set forth in the letter of November 24 previously referred to; and BE IT FURTHER RESOLVED, that Mr. Davis is also appointed City Clerk and City Treasurer, effective December 13, 1982. May and Members of the City Council City of Danville 315 Diablo Road Suite 111 Danville, California 94526 Dear Mayor May and Members of the City Council: I am delighted to accept your offer of employment as City Manager for the City of Danville. The opportunity to work with the City Council and serve in your community will be both exciting and professionally rewarding for me. Enclosed is a signed copy of your letter indicating my acceptance of the terms and con- ditions of employment as offered. It is my understanding that these terms and conditions will be included in a more finalized agreement in the near future. I am looking forward to reporting for work on December 13, and to helping the City Council achieve those aspirations for the City which were inherent in the vote for incorporation. Davis 2421 California Avenue Carmichael, California 95608 Dear Mr. Davis: As a result of our interviews with you on November 5 and 16 and based on subsequent negotiations between you and George Gaekle, our Interim Manager, the City Council makes an offer of employment as City Manager to you according to the following terms: 1. The base salary will be $45,000 per year. The Council will consider an annual increase based on performance evaluation and economic facts. 2. In add. ition, the Council will provide a monthly allowance of 25% of the base salary for you to purchase, at your discretion, various fringe benefits. The Council will also provide a car allowance of $200 per month and reimburse you for actual and necessary expenses for authorized travel. 3. You will be allowed 22 days annual leave for vacation, illness or other reasons with no carryover of unused leave from one year to the next. 4. The Council will provide financial assistance to you for the purpose of acquiring permanent housing in Danville to the extent of a loan not to exceed $60,000. The loan shall bear interest at a rate to be determined which shall be not less than the rate of return the City would receive from investing in the Local Agency Investment Fund compounded annually. The loan shall be secured by a second deed of trust. It will be due and payable either at your option to prepay without penalty, upon termination of employment or five years from the date of the loan, whichever occurs first. Principal and interest will all be due and payable at that time. If the loan is not paid off at the end of five years, and you are still employed as the City Manager, you and the City may agree to extend the loan for additional one-year periods. Michael M. In the event that the Council terminates your employment for reasons other than willful misconduct in office, you will receive severence pay of 30 days for each year of employment up to a maximum of 90 days. Should you inform the Council that you desire to terminate your employment, the Council will expect notice of at least 30 days. 6. Before you establish permanent residence in Danville or for a maximum period of four months, whichever occurs first, the Council will reimburse you for lodging and meals not to exceed $200 per week. 7. If you accept this offer of employment, the appointment shall be effective December 13, 1982.
