A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DANVILLE
APPROVING THE FINAL MAP AND SUBDIVISION AGREEMENT
FOR IMPROVEMENT WARRANTY, ACCEPTING THE IMPROVEMENTS
AS COMPLETE WITH MINOR DEFICIENCIES, AND DECLARING
STARVIEW DRIVE TO BE A CITY STREET, FOR
SUBDIVISION 5045
The following documents were presented for Council approval this date:
The Final Map of Subdivision 5045, said map having been certified
by the proper officials;
A Subdivision Agreement for Improvement Warranty with Diablo Properties,
Inc., subdivider, whereby said subdivider agrees to guarantee all improvements
as required in said Agreement for one year from the date of said agreement;
Said documents were accompanied by the following:
Security to guarantee the road and drainage improvements as required
by Title 9 of the City Ordinance Code, as follows:
a. Cash deposit in the amount of $2,340 made by Diablo Properties,
Inc.
b. Additional security in the form of:
A corporate surety bond dated September 9, 1982, and issued by Fidelity
and Deposit Company of Maryland (Bond No. 9643152) with Diablo Properties, Inc.
as principal, in the amount of $32,700 for faithful performance and maintenance
and $117,000 for labor and materials.
The City Engineer has notified this Council that the improvements
in the above-named subdivision have been completed without the need for a Subdivision
Agreement, and that these improvements have been completed with the exception
of minor deficiencies, for which a $3,000 cash deposit has been made by Diablo
Properties, Inc. to insure correction of deficiencies.
NOW THEREFORE BE IT RESOLVED that the improvements have been completed
for the purpose of establishing a six-month terminal period for filing of liens
in case of action under said Subdivision Agreement for Improvement Warranty;
and,
BE IT FURTHER RESOLVED that said Final Map is APPROVED.
BE IT FURTHER RESOLVED that said Subdivision Agreement for Improvement
Warranty is APPROVED.
BE IT FURTHER RESOLVED that the hereinafter described road as shown
and dedicated for public use on the Final Map of Subdivision 5045 is ACCEPTED
and DECLARED to be a City Street of The City of Danville:
STARVIEW DRIVE 28'/RW Varies 0.06 mile
BE IT FURTHER RESOLVED that the $2,340 cash deposited by Diablo Properties,
Inc. be RETAINED for one year pursuant to the requirements of Section 94-4.406
of the Ordinance Code.
PASSED, APPROVED AND ADOPTED this 20th day of September 1982, by the
following vote:
AYES: Lane, Mc Neely, Offenhartz, $chlendorf
NOES: None
