DENYING LAND USE PERMIT REQUEST LUP 2001-35 ALLOWING MINOR
MODIFICATIONS TO THE SYCAMORE PARK & RIDE FACILITY ALLOWING
COMMUTER VEHICLE EXCHANGE SERVICES, LLC TO
MANAGE PRIVATE VEHICLE SALES INFORMATION
EXCHANGE ON THE SITE DURING WEEKEND HOURS
(APr: 216-061-001)
WHEREAS, Commuter Vehicle Exchange Services, LLC (applicant) has requested
approval of a Land Use Permit request (LUP 2001-35) to operate a Commuter Vehicle
Exchange business on a 7.0 ± acre Town-owned site; and
WHEREAS, the subject site is located at the northeast corner of Interstate 680 and San
Ramon Valley Boulevard and is further identified as Assessor's Parcel Number 216-061-001;
and
WHEREAS, the Town of Danville A-2; General Agricultural District Ordinance requires
approval of a Land Use Permit prior to the proposed use of the site; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
January 8, 2002; and
WHEREAS, the project has been found to be Categorically Exempt from the California
Environmental Quality Act (CEQA); and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations,
and testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville denies without
prejudice the Land Use Permit request LUP 2001-35 and makes the following findings in
support of this action:
The proposed land use will be detrimental to the health, safety, and general welfare of
the Town because the operation is not appropriately located on the subject property to
minimize potential adverse impacts to surrounding properties.
The land use will adversely affect thc orderly development of property within the
Town because the proposed land use is located within the Sycamore Park & Ride
facility.
The land use will adversely affect the preservation of property values and the
protection of the tax base within the Town.
The land use will adversely affect the policy and goals as set by the Danville 2010
General Plan.
The land use will create a nuisance and/or enforcement problem within the
neighborhood or community because it is within the Sycamore Park & Ride facility.
6. The land use will encourage marginal development within the neighborhood.
DENIED without prejudice by the Danville Planning Commission at a regular meeting on
January 8, 2001, by the following vote:
