APPROVING A ONE-YEAR TIME EXTENSION OF A PREVIOUSLY APPROVED
MINOR SUBDIVISION MS 856-97 ALLOWING
A FOUR PARCEL SUBDIVISION OF A 5.04 ACRE
SITE (APN: 206-020-060 -YEE)
WHEREAS, John and MaymieYee have requested approval of a one-year time extension of a
previously approved Minor Subdivision (MS 856-97) which allowed for the subdivision of a
5.04+/- acre site into four parcels; and
WHEREAS, John and MaymieYee have previously received approval of a one-year time
extension of the approved Minor Subdivision (MS 856-97); and
WHEREAS, the subject site is located at 50 Hidden Hills Place and is further identified as
Assessor's Parcel Number 206-020-060; and
WHEREAS, the Town of Danville Subdivision Ordinance allows for extensions of a previously
approved parcel map for a maximum time period of 24 months; and
WHEREAS, a previous extension request constituted the first 12-month extension, extending the
valid time period for the approval until October 28, 2001; and
WHEREAS, the subject extension request constitutes the second 12-month extension, extending
the valid time period for the approval until October 28, 2002; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on July
10, 2001; and
WHEREAS, the project has been found to be Ministerially Exempt from the requirements of the
California Environmental Quality Act (CEQA); and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Planning Commission approve
the request; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED~ that the Planning Commission of the Town of Danville approves a one-year time
extension of MS 856-97, and makes the following findings in support of this action:
1 The proposed project is consistent with the Danville 2010 General Plan.
2. The uses authorized and the subdivision of land are consistent with the requirements of
the subject P-l; Planned Unit Development District.
3. Conditions within the neighborhood are substantially the same as the conditions under
which the project was originally approved
4. The exercise of the previously approved Minor Subdivision will not result in an adversely
impact the health, safety, or welfare of the Town
APPROVED by the Danville Planning Commission at a regular meeting on July 10, 2001, by the
following vote:
