HomeMy WebLinkAbout2000-29 EXHIBIT A RESOLUTION NO, 2000-29 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING FINAL DEVELOPMENT PLAN REQUEST DP 2000- ALLOWING THE CONSTRUCTION OF FOUR SINGLE FAMILY HOMES ON FOUR RESIDENTIAL LOTS CREATED UNDER SD 8308. (APN: 206-020-049 - BRADDOCK & LOGAN) WHEREAS, Braddock & Logan have requested approval of a Final Development Plan (DP 2000-18) to allow the construction of four single family home on four vacant parcels; and WHEREAS, the subject site is located off Senna Court and is further identified as Assessor' s Parcel Number 206-020-049; and WHEREAS, the Conditions of Approval of subdivision SD 8308 reqmre that the development of the subject lots be subject to approval of a Development Plan application, and return to the Planning Commission for final review and approval; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on October 24, 2000; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville approves the Final Development Plan request DP 2000-18 per the conditions contained herein, and makes the following findings in support this action: DEVELOPMENT PLAN FINDINGS: The proposed siting and architecture of the new residence will not conflict with the intent and purposes of Ordinance 29-84 ("Scenic Hillside and Major Ridgeline Development"), in that development will be achieved with minimal grading and will not adversely impact predominate views of a Town-identified Scenic Hillside or Major Ridgeline area. The proposed development is in conformance with the goals and policies of the 2010 General Plan. The proposed development is in conformance with the zoning district in which the property is located. CONDITIONS OF APPROVAL Conditions of approval with an asterisk ("*") in the left-hand column are standard project conditions of approval. Unless otherwise specified, the following conditions shall be complied with prior to the issuance of a building permit for the project. Each item is subject to review and approval by the Plm~nmg Division unless otherwise specified. A. GENERAL This approval is for a Development Plan request (DP 2000~18) to allow the construction four single family homes on four parcels created in March 2000, as part of subdivision SD 8308. Development shall be substantially as shown on the project drawings as follows, except as may be modified by conditions contained herein; Preliminary Development Plan, Site Plan Elevations, Architectural Plans and Floor Plans labeled "Senna Property," consisting of eight sheets, as prepared by William Hezmalhalch Architects, Inc. and dated received by the Planning Division on June 27,2000. Preliminm-y Landscape Plan labeled "Braddock & Logan," consisting of one sheet, as prepared by James Swanson and entitled Braddock & Logan SD 8308, and dated received by the Planning Division on October 19, 2000 Site Plan labeled "Site Development Plan, Braddock & Logan," consisting of one sheet, as prepared by J. E. Schuricht & Associates, and dated received by the Planning Division on June 27, 2000. PAGE 2 OF RESOLUTION NO. 2000-29 Prior to the issuance of a grading or building permit, whichever occurs first, the applicant shall reimburse the Town for notifying surrounding neighboring residents of the public hearing. The fee shall be $246.00 (328 notices X $0.75 per notice). The applicant shall be subject to all conditions of approval established under subdivision SD 8308. Backflow preventors shall be screened from view and placed in a location to minimize appearance. The landscape plan shall include additional trees along Culet Ranch Road north of Lot 1 to provide further screening. The applicant shall work with the City Engineer to evaluate the drainage risk related to the placement of the fence along the southeast property line of Lot 4 and establish necessary modifications to alleviate the neighbors concerns prior to the issuance of a building permit.
