HomeMy WebLinkAbout2000-07RESOLUTION NO. 00-07 REVISED FINAL DEVELOPMENT REQUEST DP 00-06 FOR SUBDIVISIONS SD 8165 ALLOWING THE CONSTRUCTION OF CONCRETE DRIVEWAYS LOCATED WITH THE 20 +/- FOOT WIDE LANDSCAPE STRIP WHICH RUNS IN FRONT OF THE HOMES IN THESE SUBDIVISIONS, RATHER THAN GRASS DRIVEWAYS AS PREVIOUSLY APPROVED (BRADDOCK AND LOGAN) WHEREAS, Braddock and Logan (Owner/Applicant) has requested approval of a revised final Development Plan for subdivisions SD 8165 (Braddock and Logan's San Michele development) to allow the construction of concrete driveways located within the 20 +/- foot wide landscape strip which runs in front of the homes in these subdivision, rather than grass driveways as currently approved~ and WHEREAS, the subject site is located within the Lawrence Road area, on the east side of Lawrence Road between the Meadows development and the Lawrence Estates I development; and WHEREAS, the Town of Danville P-l; Planned Unit Development District Ordinance requires approval of a Preliminary and Final Development Plan prior to construction of a project; and WHEREAS, Planning Commission approval is required to amend the conditions of approval of a previously approved Final Development Plan; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on February 8, 2000; and WHEREAS, the project has been found to be Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED, that the Planning Commission of the Town of Danville approves the revised Final Development Plan request DP 00-06 per the conditions contained herein, and makes the following findings in support of this action: The proposed Development Plan will not be detrimental to the to the health, safety, and general welfare of the Town. The Development Plan will not adversely affect the orderly development of property within the Town. The Development Plan will not adversely affect the preservation of property values and the protection of the tax base within the Town. The Development Plan will not adversely affect the policy and goals as set by the General Plan. The Development Plan will not create a nuisance and\or enforcement problem within the neighborhood or community. The Development Plan will not encourage marginal development within the neighborhood. CONDITIONS OF APPROVAL This approval revises the previously approved conditions of approval for: Preliminary Development Plan - Rezoning request PUD 98-02 and Final Development Plan - Major Subdivision request SD 8165 (San Michele); Preliminary Development Plan - Rezoning request PUD 97-02 and allowing the construction of concrete driveways located within the 20 +/- foot wide landscape strip which runs in front of the homes in these subdivision, rather than grass driveways as currently approve& Except as may be modified by the conditions of approval contained herein, concrete driveway construction shall be substantially as shown on the project plans labeled "San Michele," dated received by the Planning Division on January 24, 2000. Except for the authorized construction of concrete driveways through the landscape/open space strip, all conditions of approval established under Town Council Resolution No. 134-98 (San Michele) shall continue to apply to the development of these subdivision. The existing curb-cuts and driveway aprons within the subdivision may be kept as currently installed. Between the driveway curb-cuts and the existing concrete driveway, the driveway width shall be limited to approximately 15 feet wide, or the minimum functional width as determined by the Planning Division. Prior to PAGE 2 OF RESOLUTION NO. 00-07 installation, the proposed driveway locations shall be staked or painted for review and approval by the Planning Division. Construction of the new driveways, including color and texture, shall match the existing driveways to the extent possible.
