APPROVING REVISED FINAL DEVELOPMENT PLAN REQEUST (DP 99-21)
ALLOWING A CHANGE IN ARCHITECTURE FOR A PREVIOUSLY
APPROVED 35-LOT RESIDENTIAL SUBDIVISION
(APN: 203-171-008, 009, 011,013)
WHEREAS, Kaufman & Broad has requested approval of a revised Final Development Plan
(DP 98-21) allowing a change in architecture for a previously approved 35-1ot residential
subdivision on an 8.4 +/- acre site; and
WHEREAS, the subject site is located on the east side of Old Blackhawk Road, at the north
terminus of Ambiance Way and is further identified as Assessor's Parcel Numbers 203-171-008,
009, 011,013; and
WHEREAS, the Town of Danville P-l; Planned Unit Development District Ordinance requires
approval of a Preliminary Development Plan - Rezoning request prior to approval of the Final
Development Plan - Major Subdivision request; and
WHEREAS, a revised Final Development Plan must be approved prior to changing and
significant elements of a previously approved final Development Plan; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
November 23, 1999; and
WHEREAS, the project has been found to be Categorically Exempt from the requirements of
the California Environmental Quality Act (CEQA); and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Planning Commission approve
the request; and
WHEREAS, the Plam~ing Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville approves revised final
Development Plan request DP 99-21 per the conditions contained herein, and makes the
following findings in support of this action:
1. The proposed development will not be detrimental to the to the health, safety, and general
welfare of the Town.

The proposed development will not adversely affect the orderly development of property
within the Town.
The proposed development land use will not adversely affect the preservation of property
values and the protection of the tax base within the Town.
The development will not adversely affect the policy and goals as set by the General Plan.
The development will not create a nuisance and\or enforcement problem within the
neighborhood or community.
The development will not encourage marginal development within the neighborhood.
CONDITIONS OF APPROVAL
Unless otherwise specified, the following conditions shall be complied with prior to issuance of a
building permit for the project. Each item is subject to review and approval by the Planning Division
unless otherwise specified.
A. GENERAL
1. This approval is for a revised final Development Plan (DP 99-21) amending two
previously approved final Development Plans (SD 8096 & SD 8197) allowing revised
architecture for a total of 35 previously approved single family lots on an 8.4 +/- acre
site. The site is located on the east side of Old Blackhawk Road, at the north
terminus of Ambiance Way, and is further identified as assessor's parcel numbers 203-
171-008, 009, 011, & 013. Except as may be modified by the conditions of approval
contained herein, development shall be substantially as shown on the project drawings
as follows:
Conceptual Site Plan and Architectural Plans labeled "The Estates at Old
Blackhawk Road," as prepared by Dahlin Group, dated received on November 18,
1999, consisting of 12 sheets.
Architectural Plans and Floor Plans labeled "The Estates at Old Blackhawk
Road," as prepared by Dahlin Group, dated received on November 18, 1999,
consisting of 12 sheets.

c. Preliminary Landscape Plan labeled "Old Blackhawk," as prepared by John Nicol
& Associates, dated received on November 18, 1999.
Where applicable (i.e., the condition of approval has not already been satisfied prior
to recordation of the final map), development of this project shall be subject to all
conditions of approval previously established under Town Council Resolution No. 8-
98 and under Town Council Resolution No. 116-98.
All masonry shown on the front elevations shall wrap around the side elevation to the
sideyard fence line.
All new fences within this project shall include 2"x 8" pressure treated kickboards
and shall utilize pressure treated Douglas Fire fence posts. In addition, the bottom
rail and top rail shall be constructed of 2'x 4" boards with l"x 1" nallers on each
side of the fence boards, rather than using dadoed 2"x 4" top and bottom rails.
Final landscape and irrigation plans (with planting shown at 1 "=20' scale) shall be
submitted for review and approval by the Planning Division. The plan shall include
common names of all plant materials and shall indicate the size that various plant
materials will achieve within a five year period of time.
The applicant shall develop four altemative fi'ont yard landscape altematives and offer
them for sale to new home buyers within this subdivision. If purchased by the new
home buyer, the developer shall install the landscaping within 90 days of occupancy
of the unit. It the home buyer does not buy one of the landscape alternatives, the new
home buyer shall have front yard landscaping installed within 90 days of occupancy
of the unit. Plans shall be submitted for review and approval by the Planning Division
prior to issuance of building permits. The four alternate landscape alternatives shall
be required to be varied throughout the project (i.e., the same alternative shall not be
used directly next to or across the street from each other).
Colors and materials shall be as shown on the color and materials board for the project
on file with the Planning Division and presented at the public hearing for this item.
The applicant shall be responsible for planting at least two trees per lot along the rear
property line of lots 8-11. The exact type and location of the trees shall be chosen
with input from the adjacent property owners to the south, subject to final review and
approval by the Planning Division.
Frontyard setbacks within the project shall be varied to the extent possible. Final

plotting shall be subject to review and approval by the Design Review Board prior to
issuance of Building Permits.
APPROVED by the Danville Planning Commission at a regular meeting on November 23, 1999 by
