A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF
DANVILLE UPHOLDING THE TOWN'S ADMINISTRATIVE DENIAL OF SIGN
PERMIT EXEMPTION REQUEST SR 99-01 TO ALLOW INTERNAL
ILLUMINATION AND UPHOLDING A PORTION OF AN APPEAL BY VINTAGE
BISTRO TO ALLOW ADDITIONALWORDING FOR A SIGN IN DOWNTOWN
BUSINESS DISTRICT 1
(APN: 199-350-019 -- VINTAGE BISTRO)
WHEREAS, Vintage Bistro has requested approval of a Sign Review exception application to
allow an exception to the Town of Danville Sign Ordinance; and
WHEREAS, the subject site is located within the Clocktower Shopping Center and is further
identified as Assessor's Parcel Number 199-350-019; and
WHEREAS, the Town of Danville Sign Ordinance requires approval of an exception to the
Ordinance for sign proposals which are not consistent with the provisions of the Sign Ordinance;
and
WHEREAS, the Town' s Sign Ordinance (Ord. No. 95-06) prohibits internal illumination within
Downtown Business District 1; and
WHEREAS, the Sign Review exception request is to allow for an internally illuminated sign
within Downtown Business District 1; and
WHEREAS, Vintage Bistro has also requested additional wording to be allowed on the sign; and
WHEREAS, the Town's Design Review Board recommended denial of both the additional
wording and internal illumination exception requests on June 10, 1999; and
WHEREAS, an appealable action letter administratively denying the application was sent to the
applicant on June 11, 1999; and
WHEREAS, the applicant submitted a letter and $200.00 appeal fee, appealing the Town's
administrative denial on June 17, 1999; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
September 14, 1999; and
WHEREAS, the project has been found to be Categorically Exempt from the California
Environmental Quality Act (CEQA); and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Planning Commission deny the
appeal; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville upholds the Town's
administrative denial of Sign Review exception request SR 99-01 to allow intemal illumination,
and upholds the portion of an appeal by Vintage Bistro to allow additional wording for a sign
located within Downtown Business District 1, and makes the following findings in support of this
action:
The proposed project is not consistent with the Town of Danville Sign Ordinance, as
Section 32-98.3 of the Ordinance prohibits internal illumination in Downtown Business
District 1.
No special circumstances or hardships have been identified to justify granting of the sign
exception requested.
Granting of the sign exception would be unfair to other businesses that comply with the
requirements of the Sign Ordinance and would constitute a grant of special privilege.
4. The illuminated signage is unnecessary to adequately identify the business.
