HomeMy WebLinkAbout99-23 EXHIBIT A RESOLUTION NO. 99-23 RECOMMENDING THE DANVILLE TOWN COUNCIL ADOPT A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE AND APPROVE GENERAL PLAN AMENDMENT REQUEST GPA 99-02 -- DANVILLE 2010 GENERAL PLAN UPDATE WHEREAS, the Town of Danville (APPLICANT) initiated General Plan Amendment request GPA 99-02, being a comprehensive update of the Danville 2005 General Plan; and WHEREAS, the project encompasses all land within the corporate boundaries of the Town of Danville (approximately 11,600 acres) and an additional 1,800 +/- acres being the unineorporated ConIra Costa County lands located within the Danville sphere of influence; and WHEREAS, Danville is located in the San Ramon Valley approximately 30 miles east of San Francisco and 40 miles northeast of San Jose; and WHEREAS, a general plan contains goals and policies that regulate development, resource management, and public safety, and also typically contain background information and implementation programs which address physical, social, and economic aspects of a community. WHEREAS, all Califomia town's, cities and counties are required by the State of Califomia to have a general plan (California Government Code Section 65300 et seq.) which addresses seven specific topics (elements): land use, housing, circulation, safety, open space, conservation, and noise (Sections 65302 and 65303), and other, optional topic areas (elements), if so desired; and WHEREAS, following the Town's incorporation in 1982, the Town Council adopted the relevant portions of the 1977 San Ramon Valley Area Plan, prepared by Contra Costa County; and WHEREAS, the Danville 2005 General Plan was the first comprehensive General Plan prepared by the Town, prepared over the course of a two year period and utilizing a citizen task force for the development of the Plan; and WHEREAS, the Danville 2010 General Plan Update integrates technical studies, General Plan Amendments, Special Study Area Plans, implementing ordinances, and design guidelines prepared by the Town since the 2005 Plan was adopted; and WHEREAS, while the Danville 2010 General Plan Update maintains many of the goals, policies and implementation measures that were first established by the 2005 Plan, new goals, policies and implementation measures have been introduced and integrated into the 2010 Plan to address the issues and challenges that have emerged over the past decade; and WBEREAS, the Danville 2010 General Plan Update also includes limited revisions to the Town's Land Use Map; and WHEREAS, Danville's 2010 General Plan Update was developed through a cooperative effort among citizens, the Town Council, the Planning Commission, the Parks and Leisure Services Commission, the Heritage Resource Commission, the Arts Commission, Town staff and consultants, and representatives of other govemment agencies; and WHEREAS, the Danville Town Council, Planning Commission, Parks and Leisure Services Commission, Heritage Resource Commission and/or Arts Commission conducted approximately 36 study sessions and public workshops during 1998 and 1999 to evaluate possible changes to the Land Use Map and provide policy and program direction for the updated Plan.; and WBEREAS, review and discussion of each goal, policy and implementation measure contained in the 2005 Plan occurred through this process; and WHEREAS, during Summer, 1998, the Town sponsored six public forums to solicit community input on Danville's future as well as specific ideas for approximately 45 "Opportunity Sites" and 13 "Special Concern Areas;" and WHEREAS, a draft Mitigated Negative Declaration of environmental significance has been prepared for the Danville 2010 General Plan Update, as required by the California Environmental Quality Act (CEQA), indicating that, as amended through project modifications or recommended mitigation measures, no significant environmental impacts are expected to be associated with the project; and WHEREAS, the draft Mitigated Negative Declaration of Environmental Significance was circulated to responsible and/or interested agencies, groups, and individuals during a thirty- day public review period; and WHEREAS, joint study sessions and a public workshop were conducted which allowed public comment on the Public Release Draft of the 2010 General Plan and the Draft Mitigated Negative Declaration of Environmental Significance on June 22, 1999, June 26, 1999, June 29, 1999, and on July 6, 1999; and WHEREAS, the Public Release Draft of the 2010 General Plan has been amended to address pertinent concerns and comments raised during the above listed meetings; and PAGE 2 OF RESOLUTION NO. 99-23 WItEREAS, the Planning Commission did review the project at a noticed public hearing on July 13, 1999; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville recommends that the Danville Town Council adopt a Mitigated Negative Declaration of Environmental Significance and approve General Plan Amendment GPA 99-02 - Danville 2010 General Plan.
