HomeMy WebLinkAbout99-05 EXHIBIT A RESOLUTION NO. 99-05 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DENYING, WITHOUT PREJUDICE, MINOR SUBDIVISION REQUEST MS 862-98 AND VARIANCE REQUEST VAR 98-28 (APN: 200-220-017 --- OHLSON) WHEREAS, Thomas and Gloria Ohlson, Trustees have requested approval of a Minor Subdivision request MS 862-98 and Variance request VAR 98-28 to allow a two parcel minor subdivision on a 1.0 +/- hectare parcel (2.49 acres); and WHEREAS, a Variance (VAR 98-28) is requested to allow the creation of a 59,847 +/- square foot lot where a 65,000 +/- square foot lot is required under the Town's R-65; Single Family Residential District; and WHEREAS, the subject site is located at 10hlson Lane and is further identified as Assessor's Parcel Number 200-220-017; and WHEREAS, the Town of Danville Subdivision Ordinance require approval of a Minor Subdivision - Vesting Parcel Map prior to the recordation of a Parcel Map; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on February 23, 1999; and WHEREAS, a Negative Declaration of Environmental Significance has been prepared for the project indicating that no significant environmental impacts are expected to be associated with the project; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville denies, without prejudice, the Minor Subdivision request MS 862-98 and Variance request VAR 98-28 per the conditions contained herein, and makes the following findings in support of this action: Subdivisions: , The density of the proposed subdivision is not in substantial conformance with the applicable General Plan and zoning regulations. Variances The approval of a variance would deny the rights of other property owners in the vicinity unnecessarily. The granting of a variance would be contrary to the Town's commitment to maintain the rural character of this area.
