HomeMy WebLinkAbout98-56 EXHIBIT A RESOLUTION NO. 98-56 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING DEVELOPMENT PLAN REQUEST DP 98-46 AMENDING PREVIOUSLY APPROVED FINAL DEVELOPMENT PLANS ALLOWING REVISED ARCHITECTURE FOR TWO PREVIOUSLY APPROVED SUBDIVISIONS TOTALLING 35 SINGLE FAMILY LOTS (APN: 203-171-008,-009,-011,-013 - KAUFMAN & BROAD) WHEREAS, Kaufman & Broad of Northern California Inc. has requested approval of a Development Plan request (DP 98-46) to amend two previously approved final Development Plans and to allow revised architecture for a total of 35 previously approved single family lots on an 8.4 +/- acre site; and WHEREAS, the subject site is located on the east side of Old Blackhawk Road, south of Lacewood Way and is further identified as Assessor's Parcel Numbers 203- 171-008, 009, 011, and 013; and WHEREAS, the Town of Danville P-l; Planned Unit Development District Ordinance requires approval of an amended final Development to amend provision of a previously approved final Development Plan; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on December 22, 1998; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS~ a staff report was submitted recommending that Pianning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville of the revised final Development Plan (DP 98-46) per the conditions contained herein, and makes the following findings in support of this action: The proposed Development Plan will not be detrimental to the to the health, safety, and general welfare of the Town. PAGE 1 OF RESOLUTION NO. 98-56 2. The Development Plan will not adversely affect the orderly development of ~ property within the Town. The Development Plan will not adversely affect the preservation of property values and the protection of the tax base within the Town. The Development Plan will not adversely affect the policy and goals as set by the General Plan. The Development Plan will not create a nuisance and\or enforcement problem within the neighborhood or community. The Development Plan will not encourage marginal development within the neighborhood. CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with prior to issuance of a building permit for the project. Each item is subject to review and approval by the Planning Division unless otherwise specified. A. GENERAL This approval is for a revised final Development Plan (DP 98-46) amending two previously approved final Development Plans (SD 8096 & SD 8197) allowing revised architecture for a total of 35 previously approved single family lots on an 8.4 +/- acre site. The site is located on the east side of Old Blackhawk Road, north of Lacewood Way, and is further identified as assessor's parcel numbers 203-171-008, 009, 011, & 013. Except as may be modified by the conditions of approval contained herein, development shall be substantially as shown on the project drawings as follows: a. Architectural plans labeled "Old Blackhawk," as prepared by Kaufman & Broad Architecture, on file with the Planning Division. b. Landscape Concept Plan labeled "Old Blackhawk Village," as prepared by Kaufman & Broad, on file with the Planning Division. C, Site and House Plotting Plan labeled "Final Development Plan - Subdivision 8096 - Old Balckhawk Village," as prepared by David Evans and Associates, Inc., on file with the Planning Division. Where applicable (i.e., the condition of approval has not already been satisfied prior to recordation of the final map), development of Lots 1- PAGE 2 OF RESOLUTION NO. 98-56 , 9. 10. 11. 66, 18-24 and 25-35 shall be subject to all conditions of approval previously established under Town Council Resolution No. 8-98. The development of Lots 7-17 shall be subject to all conditions of approval previously established under Town Council Resolution No. 116-98. All masonry shown on the front elevations shall wrap around the side elevation to the sideyard fence line. All project fences shall be of solid wood design and shall utilize minimum 4"x 4" pressure treated Douglas Fir fence posts and 2"x 8" (minimum height) kickboards, unless otherwise approved by the Planning Division. Final landscape and irrigation plans (with planting shown at 1"-20' scale) shall be submitted for review and approval by the Planning Division. The plan shall include common names of all plant materials and shall indicate the size that various plant materials will achieve within a five year period of time. The applicant shall develop three alternative front yard landscape alternatives and offer them for sale to new home buyers within this subdivision. If purchased by the new home buyer, the developer shall install the landscaping within 180 days of occupancy of the unit. It the home buyer does not buy one of the landscape alternatives, the new home buyer shall have front yard landscaping installed within 180 days of occupancy of the unit. Plans shall be submitted for review and approval by the Planning Division prior to issuance of building permits. Colors and materials shall be as shown on the color and materials board for the project on file with the Planning Division and presented at the public hearing for this item. Proposed "S" tile roof tiles shall not be colored terracotta red. Metal doors for the home (except garage doors) shall not be allowed. The home to be constructed on Lot 11 shall utilize a 4.5 foot solid wood fence with a 1.5 foot trellis top for the sideyard (street side) elevation. This fence shall be designed to match the adjacent fences within the Belletterre subdivision to the south. The applicant shall be responsible for planting at least two trees per lot along the rear property line of lots 8-11. The exact type and location of the trees shall be chosen with input from the adjacent property owners PAGE 3 OF RESOLUTION NO. 98-56 to the south, subject to final review and approval by the Planning Division.
