APPROVING A ONE-YEAR TIME EXTENSION OF A PREVIOUSLY APPROVED
FINAL DEVELOPMENT PLAN (DP 96-29) EXENDING THE VALID
APPROVAL PERIOD FOR A SERVICE STATION, CAR
WASH, AND CONVENIENCE STORE LOCATED AT
3500 CAMINO TASSAJARA -- EXXON
WHEREAS, Exxon Corporation has requested approval of a one-year time extension for a
previously approved Final Development Plan (DP 96-29) which allowed for the development
of a service station, car wash, and convenience store; and
WHEREAS, the subject site is located at 3500 Camino Tassajara, at the southeast corner of
Camino Tassajara and Tassajara Ranch Drive and is further identified as Assessor's Parcel
Number 206-010-0049; and
WHEREAS, the Town of Danville Municipal Code requires approval of an extension of
time to allow for the development of the project more than one year after the approval of the
Final Development Plan; and
WHEREAS, the applicant has submitted a letter requesting a one-year time extension for the
project; and
WHEREAS, the Danville Municipal Code allows the Danville Town to grant up to five one-
year extensions; and
WHEREAS, the Danville Planning Commission did review the project at a noticed public
hearing on December 8, 1998; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations,
and testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Danville Planning Commission approves of the one-year time
extension of Development Plan DP 96-29, and makes the following findings in support of
this action:
1. The one-year time extension would allow for the development of a proposed project
which is consistent with the Danville 2005 General Plan.
The one-year time extension would allow for the development of a proposed project
which is consistent with the P-l; Planned Unit Development District previously
approved for the site.
Circumstances related to the development of the site are substantially the same as the
circumstances under which the project was originally approved.
The one-year time extension for the proposed project would not result in any health,
safety, or welfare impacts to the surrounding neighborhoods or the Town.
The one-year time extension will allow for the completion of a thorough review of the
project's building permit application and will allow the start of the project to be
delayed until after the rainy season.
APPROVED by the Danville Planning Commission at a regular meeting on December 8,
1998 by the following vote:
