HomeMy WebLinkAbout98-49 EXHIBIT A RESOLUTION NO. 98-49 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE RECOMMENDING THE TOWN COUNCIL AMEND THE TOWN'S DOWNTOWN BUSINESS DISTRICT ORDINANCE, REPEALING A MORATORIUM AND LIMITING SERVICE OFFICE AND SERVICE COMMERCIAL USES ON THE GROUND FLOOR WITHIN DOWNTOWN BUSINESS DISTRICTS ONE AND TWO WHEREAS, the Town of Danville has-requested approval of a Zoning Text ,~nendment (ZTA 98-01 ) repealing previous amendments and restricting service commercial and service office uses in first floor tenant spaces within Downtown Business Districts 1 and 2: and WHEREAS, a moratorium on the land use limitation within Downtown Business Districts 1 2, allowing service office and service commercial uses to occupy first floor tenant space on an unlimited bases, was approved by the Town Council in May of 1995 and in Max' of 19cW: and WHEREAS, this moratorium is set to expire on May 1, 1999; and WHEREAS, in order to promote a pedestrian character, it is desirable to restrict the ma:jority of land uses in the core downtown area to retail and restaurant uses: and WHEREAS, given the current strong economic climate, repealing the sut2ject moratorium earlx' is not expected to have an adverse impact on economic viabiliw in the downto~vn areax and WHEREAS, the Planning Commission did review the project at a noticed public hearing on November 10, 1998~ and WHEREAS, the public notice of this action was given in all respects as required bv law: and WHEREAS, a staff report was submined recommending that Planning Commission approve the requestx and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing: now, therefore, be ~t RESOLVED that the Planning Commission of the Town of Danville recommends the Town Council approve Zoning Text Amendment (ZTA 98-01) repealing previous amendments and restricting service commercial and service office uses m first floor tenant spaces wnhm Downtown Business Districts I and 2, and makes the following findings in support of this action PAGE I OF RESOLUTION NO. 98-49 The proposed project is consistent with the Danville 2005 General Plan The land use recommendation is consistent with the purpose and intent of the Town's Downtown Business District Ordinance.
