HomeMy WebLinkAbout98-35 EXHIBIT A RESOLUTION NO. 98-35 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING DEVELOPMENT PLAN REQUEST DP 98-41 APPROVING FINAL DETAILS RELATED TO A PREVIOUSLY APPROVED 4,980 +/- SQUARE FOOT HOME TO BE LOCATED WITHIN A TOWN-IDENTIFIED SCENIC HILLSIDE AREA (APN: 206-170-009 -- DEHERRERA) WHEREAS, Rick DeHerrera has requested approval of a Development Plan (DP 98-41) approving final details related to a previously approved 4,980 +/- square foot home located within a Town-identified scenic hillside area on an 8.72 +/- acre site; and WHEREAS, the subject site is located at 1615 Lawrence Road and is further identified as Assessor's Parcel Number 206-170-009; and WHEREAS, the 4,980 +/- square foot home was previously approved by the Planning Commission on July 22, 1997, under Development Plan DP 96-33, subject to the conditions of approval contained within Resolution No. 175-97; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on July 28, 1998; and WHEREAS, the Planning Commission continued the item to the Commission' s August 11, 1998 meeting and requested that additional information be prepared regarding the proposed scenic easements related to the development; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville approves Development Plan request DP 98-41 per the conditions contained herein, and makes the following findings in support of this action: PAGE 1 OF RESOLUTION NO. 98-35 The proposed siting and architecture of the new residence will not conflict with the intent and purposes of Ordinance 29-84 ("Scenic Hillside and Major Ridgeline Development"), in that development will be achieved with minimal grading and will not adversely impact predominate views of a Town-identified Scenic Hillside or Major Ridgeline area. The proposed development is in conformance with the goals and policies of the General Plan and the LawrenceZLeema Road Specific Plan. The proposed development is in conformance with the zoning district in which the property is located. The proposed final details of the development are substantially consistent with the previously approved conditions of approval for the project. CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with prior to the issuance of a building permit for the project. Each item is subject to review and approval by the Planning Division unless otherwise specified. A. GENERAL This approval is for a Development Plan request (DP 98-41) approving final details related to the construction of a previously approved 4,980 +/- square foot home to be constructed within a Town-identified Scenic Hillside area. Development shall be substantially as shown on the project drawings as follows, except as may be modified by conditions contained herein; Site Plan, Floor Plan, Exterior Elevations, Landscape Plan, Road Improvement Plans, and Bridge Plans labeled "DeHerrera Residents," consisting of nine sheets, dated received by the Planning Division on July 24, 1998. Site Plan/Scenic Easement Plan dated received by the Planning Division on August 6, 1998. Except as otherwise noted, all conditions of approval related to this development contained within Town Resolution No. 175-97 shall continue to apply to this development. 3. For the area located within Scenic Easement/~ 1, as noted on the project plans, no PAGE 2 OF RESOLUTION NO. 98-35 future development, including structures of any kind and grading, will be allowed. For the area designated as Scenic Easement ~2, no development will be allowed except that minor accessory structures, such as a horse barn or corral, may be allowed, subject to review and approval of a Development Plan application by the Planning Commission. In addition to the approved access trail as shown on the above referenced plans, an access trail is approved to be located down the south slope of the property, extending from the rear of the garage parallel to the east property line. The access trail which extends around the hill on the north side of the site shall be no wider than necessary for one vehicle, and shall not be paved. The trail approved for the south slope of the property shall be a foot trail only, and shall not be graded or paved. Exterior lighting fixtures shall be as shown on the detail sheet on file with the Planning Division and attached as Exhibit D of this staff report. Vines shall be planted to grow over the retaining walls to be constructed in conjunction with the project driveway, subject to review and approval by the Planning Division.
