HomeMy WebLinkAbout98-19EXHIBIT A RESOLUTION NO. 98-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING SIGN PERMIT REQUEST SR 97-11 BEING THE FINAL MASTER SIGN PROGRAM FOR THE IRON HORSE PLAZA SHOPPING CENTER LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF RAILROAD AVENUE AND SAN RAMON VALLEY BOULEVARD (APN: 208-340-004) WHEREAS, C & H Development have requested approval of a Final Master Sign Program for the proposed 69,000+/- square foot Iron Horse Plaza Shopping Center; and WHEREAS, the subject site is located at the northwest corner of the intersection of Railroad Avenue and San Ramon Valley Boulevard and is further identified as Assessor's Parcel Number 208-340-004; and WHEREAS, the Town of Danville Sign Ordinance requires Town approval of Master Sign Programs, and any subsequent amendments to a Master Sign Program, for multi- tenant commercial centers; and WHEREAS, a Mitigated Negative Declaration of Environmental Significance for the subject shopping center was previously prepared and adopted in conjunction with the approval of the Final Development Plan for the shopping center (i.e., DP 97-10), which can be utilized for this request; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on April 14, 1998; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the Final Master Sign Program request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville approves the proposed Final Master Sign Program request SR 97-11 per the conditions contained herein, and makes the following findings in support of this action: The signage is consistent in character with the Town's commercial design guidelines, is compatible with project architecture, and is no larger than necessary for adequate identification. The signage will serve primarily to identify the business, establishment or type of activity conducted on the premises, or the product, service or interest being exhibited or offered for sale, rent or lease on the premises. 3. The signage will not excessively compete for the public's attention. The signage will be harmonious with the materials, color, texture, size, shape, height, location, design and in proportion with the architectural style of the building, property or environment of which they are a part. The design of the signage will be consistent with professional graphic and structural standards. Signage illumination will be at the lowest level consistent with adequate identification and readability. CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with on a tenant space-by-tenant space basis prior to the issuance of building permits for respective tenant improvements pursued for this project. Each item is subject to review and approval by the Planning Division unless otherwise specified. A, GENERAL This approval is for the Final Master Sign Program for Iron Horse Plaza Shopping Center. All signage shall be consistent with the Master Sign Program entitled "Master Sign Program Iron Horse Plaza - Danville, CA", prepared by Architectural Dimensions and dated received by the Planning Division on April 9, 1998. All sign illumination shall be at the lowest level consistent with adequate identification and legibility. The following language shall be added: "Window Signs shall be consistent with the requirements of the Town of Danville Sign Ordinance Window Sign requirements, with the exception that no neon "Open" signs, or neon "product" signs shall be displayed within ten feet of any window within the center. Revisions to the approved Final Master Sign Program are subject to review and approval by the Planning Commission. Revisions may, at the discretion of the Chief of Planning, be referred to the Design Review Board for review and consideration prior to being forwarded for Planning Commission review. No building permits shall be issued for new signage, on a tenant space-by~ tenant space basis, if there are any sign violations affecting the tenant space involved with the proposed sign(s). Without prior authorization by the Planning Division, no windows in the shopping center shall be utilized for permanent window signage or partitions that block visibility to the interior of the tenant spaces. No store fixtures or displays shall be placed in front of windows that blocks visibility to the interior of the store. At the discretion of the Planning Division, staff may refer such requests to the Planning Commission for consideration and action. No window tinting is permitted in any storefront windows or doors without prior authorization from the Planning Division. Any proposed modifications to project windows, including the construction of walls, partitions or signage within five feet of the windows shall require prior review and approval of a separate Development Plan. All temporary signage utilized by the tenants in this center shall conform to the standards for temporary business signage in the Town's Sign Ordinance.
