RESOLUTION NO. 98-12
A RESOLUTION OF THE PLANNING COMMISSION OF THE
TOWN OF DANVILLE APPROVING DEVELOPMENT PLAN APPLICATION
DP 98-09 - FINA~L LANDSCAPE PLAN FOR THE LAFFERTY RESIDENCE
LOCATED AT 168 LOWELL DRIVE
(APN: 207-510-002) - LAFFERTY LANDSCAPE PLAN
WHEREAS, Richard Lafferty has requested approval of DP 98-12, Final Landscape Plan as a
follow-up to Condition of Approval B. 1. of the previously approved Land Use Permit (LUP 96-
07) and Development Plan (DP 96-09) application for the Lafferty addition and second unit; and
WHEREAS, the subject site is located in a Town-identified Scenic Hillside Area on the north
side of Lowell Drive, at 168 Lowell Drive and is further identified as Assessor's Parcel Number
207-5 l 0-002; and
WHEREAS, the subject landscape plan is for an existing single family residence with a second
dwelling unit located in a on a .72+ acre site; and
WHEREAS, the Town of Danville Scenic Hillside and Major Ridgeline Ordinance (Ord. No. 29-
84) requires approval of a Development Plan prior to grading or construction within a Town
identified Scenic Hillside area; and
WHEREAS, LUP 06-07 and DP 96-09 were approved by Planning Commission on April 23,
1996 with Condition of Approval B. 1. which required that the Final Landscape Plan be reviewed
and approved by the Planning Commission; and
WHEREAS, the Design Review Board reviewed and recommended approval of the Final
Landscape Plan for the Lafferty residence on March 11, 1998; and
WHEREAS, the Planning Commission did review the final landscape plan at a noticed public
heating on March 24, 1998; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that Planning Commission approve the
request; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED the Planning Commission of the Town of Danville approves DP 98-12 Final

All plant material shall be served by an automatic underground irrigation system
and maintained in a healthy growing condition. Irrigation shall comply with Town
of Danville Landscape Ordinance #91-14 and shall be operated to avoid runoffand
overspray.
All trees shall be a minimum of 15 gallon container size. All trees shall be properly
staked. All remaining shrubs used in the project, which are not used as ground
cover, shall be a minimum of five gallons in size.
All landscaping shall be installed by June 15, 1998. The Landscape security
deposit, in the amount of $21,968.75 (which is equal to 125 percent of the
estimated value of the installation of the landscape improvements) will be held by
the Town to guarantee the installation of landscaping.
All development shall take place in compliance with the Town Erosion Control
Ordinance (Ord. 91-25). If construction is underway during the rainy season, the
use of sediment traps and other devices shall be used to minimize erosion.

Stockpiles of debris, soil, sand or other materials that can be blown by the wind
shall be covered.

All construction activity shall address National Pollutant Discharge Elimination
System (NPDES) concerns. Specific measures to control sediment runoff,
construction pollution and other potential construction contamination shall be
addressed.

The applicant shall diligently pursue securing approval from the property owner to
the north (APN: 207-510-005) to remove silt and debris from the drainage ditch
that comes from the Lafferty residence and crosses the subject property.
