RESOLUTION NO. 98-11
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF
DANVILLE DENYING AN APPEAL AND UPHOLDING THE
ADMINISTRATIVE DENIAL OF DEVELOPMENT PLAN
DP 97-21 REQUESTING ARCHITECTURAL MODIFICATIONS
TO THE FRONT FACADE OF A COMMERCIAL SHOPPING
CENTER (APN: 216-101-002 -- EL BALAZO)
WHEREAS, Marino Sandoval has requested approval of an appeal of an administrative denial
of a Development Plan request to allow modifications to the front facade of a tenant space within
the Crossings of Danville shopping center including painting the front wall and the placement
of brick columns and arches on a 3.1+/- acre site; and
WHEREAS, the subject site is located on the southeast corner of San Ramon Valley Blvd. and
Hartz Way, at 480 San Ramon Valley Blvd., space H, and is further identified as Assessor's
Parcel Number 216-101-002; and
WHEREAS, the Town of Danville Downtown Business District Ordinance requires approval
of a Development Plan prior to the modification of the exterior of any commercial structure; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
March 10, 1998; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Planning Commission approve
the request; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville denies the appeal and
denies the Development Plan request DP 97-21 and makes the following findings in support of
this action:
The modifications to the shopping center are not consistent or compatible with the
architectural treatments for the overall shopping center.
2. The modifications to the shopping center are not consistent with the previously approved

Development Plan for the overall shopping center and would set a precedent allowing
multiple uncoordinated front elevation treatments which could lead to a significant
deterioration of the appearance of the shopping center.
The modifications to the shopping center consist of uncoordinated and incompatible
development within the shopping center which is inconsistent with the intent of the
Town's Downtown Business District Ordinance.
The modifications to the shopping center consist of an uncoordinated and incompatible
development within the shopping center which is inconsistent with the intent of Danville's
General Plan.
The modifications excessively compete for the public's attention.
APPROVED by the Danville Planning Commission at a Regular Meeting on March 10, 1998
