RESOLUTION NO. 97-27
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF
DANVILLE APPROVING NOTICING POLICIES FOR TOWN OF
DANVILLE PLANNING COMMISSION PUBLIC HEARINGS
WHEREAS, the Town of Danville Planning Division and Planning Commission wish to adopt
noticing policies for Planning Commission public hearings; and
WHEREAS, the noticing policies would be applicable Town-wide for planning related
applications which are subject to review by the Danville Planning Commission; and
WHEREAS, the Danville Planning Commission and Danville Town staff desire to develop
noticing procedures which minimize noticing errors and maximize the opportunity for all
interested parties to be informed of pending pulbic hearings to facilitate their participation in the
public hearing process; and
WHEREAS~ the Planning Commission did review the public hearing noticing policies at a
noticed public hearing on August 26, 1997; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS~ a staff report was submitted recommending that Planning Commission approve the
request; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Danville Planning Commission approves of the Planning Commission
Noticing Policies as described below:
PLANNING COMMISSION PUBLIC HEARING NOTICING POLICY
The Town shall notice all property owners within 300 feet of the boundaries of a project
site of pending public hearings. Staff shall verify that all properties within 300 feet are
included in the mailing list by cross-checking the mailing list against a list of all
Assessor's Parcel Numbers within 300 feet. The notice shall be based on the most recent
property ownership information reasonably available to the Town.
When appropriate, the noticing limits for pending public hearings shall be extended
beyond 300 feet. The noticing boundary will be extended when it is determined by Town
staff that it would be appropriate to extend noticing further than the 300 feet minimum
standard in order to complete a logical noticing area (e.g., such as extending the notice
to the end of a block or cul-de-sac, or to include both sides of a street.)
Representatives of all known surrounding and/or potentially effected homeowners'
associations shall be notified by mail of pending public hearings. For projects within the
Downtown Business District, the Danville Area Chamber of Commerce and the Danville
Merchant's Association shall be notified by mail of such public hearings.
All other groups, organizations, or individuals who have expressed interest in the public
hearing item, either verbally or in writing, shall be noticed by mail.
For more controversial projects and/or projects which are likely to have an effect on
properties, individuals or groups which are located outside of the mailed notice area (as
determined by Town staff or the Planning Commission), the site shall be posted with a
notice of the public heating. The public hearing notice shall be posted on a free standing
post, shall be attached to a sturdy backing, and shall be placed near each property frontage
which abuts a public right-of-way and shall be large enough to be read from the public
right-of-way.
6. Notice of public hearings shall be published in local newspapers as required by law.
Planning Commission meeting agendas shall be posted in three public building locations
as required by law.
All Planning Commission staff reports shall include a noticing boundary map and/or
narrative describing the specific notification efforts for that project.
The Town shall add all persons who fill out a speaker card to the mailed notice list in the
case the item is continued to a subsequent public hearing and is re-noticed.
