RESOLUTION NO. 97-23
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF
DANVILLE RECOMMENDING ADOPTION OF A NEGATIVE DECLARATION
OF ENVIRONMENTAL SIGNIFICANCE AND APPROVE GENERAL PLAN
AMENDMENT (GPA 97-01) AND PREZONING (PRZ 97-01) REQUEST TO AMEND
THE TOWN'S LAND USE MAP AND ZONING MAP TO INCLUDE A
44 +/- ACRE PROPERTY COMMONLY KNOWN AS "THE MEADOWS"
WHEREAS, the Town of Danville requested approval of General Plan Amendment (GPA 97-
01) and Prezoning (PRZ 97-01) requests to amend the Town of Danville General Plan Land Use
Map and Zoning Map, adding to those maps the existing Residential - Medium Density (3-5 units
per acre) land use designation and P-1; Planned Unit Development District designation, of a 44
+/- acre parcel commonly known as "The Meadows;" and
WHEREAS, the Town of Danville has also requested approval to modify the Town's land use
map to reflect the General Plan amendment and the zoning map to reflect the prezone
designation; and
WHEREAS, the subject site is located on the southeast comer of the intersection of Camino
Tassajara and Lawrence Road, and is identified as Assessor's Parcel Number 206-020-014; and
WHEREAS, State Law (Government Code Sections 56375 and 56841 - Cortese-Knox Local
Government Reorganization Act of 1985) requires that a city must prezone an unineorporated
territory adjoining the city prior to annexation of this territory to the City; and
WHEREAS, the Town Council has approved a Preannexation and Processing Agreement with
Kaufman and Broad for The Meadows; and
WHEREAS, the Town Council has adopted Resolution No. 108-97, applying to the Contra
Costa Local Agency Formation Commission to annex uninhabited territory to the Town of
Danville (The Meadows); and
WHEREAS, Government Code Sec. 65859 (Zoning Regulations) allows a city to prezone
unincorporated territory adjoining the city for the purpose of determining the zoning that will
apply to such property in the event of subsequent annexation to the city; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
August 12, 1997; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
,..,. WHEREAS, a staff report was submitted recommending that Planning Commission approve the
requests; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville recommends that the Town
Council adopt the Negative Declaration of Environmental Significance and approve GPA 97-01
and PRZ 97-01 to amend the Town's General Plan Land Use Map and Zoning Map to include
a 44 +/- acre property commonly known as "The Meadows," and make the following findings in
support oftbis action:
General Plan Amendment (GPA 97-01)
The proposed project is consistent with the Comprehensive General Plan Goals contained
in the Danville 2005 General Plan.
The proposed project is consistent with the goals and policies for Urban Development
contained in the Danville 2005 General Plan.
3. The proposed project is consistent with:
The General Plan Growth Management Element Performance Standards and Level
of Service Standards for Basic Routes; and
The Tri-Valley Transportation Plan/Action Plan for Routes of Regional
Significance.
Prezone (PRZ 97-01)
1. The proposed prezoning is consistent with the Danville 2005 General Plan.
The area constitutes single family residential development of sustained desirability, which
is in character with the surrounding environment and community.
CEQA
The Negative Declaration prepared, fully and adequately addresses potential impacts
associated with this action, satisfying the requirements of CEQA.
2. Based on the completion of the Initial Study of Environmental Significance and comments

,-, received, there is no substantial evidence before the Town that the project will have a
significant effect on the environment.
APPROVED by the Danville Planning Commission at a Regular Meeting on August 12, 1997
by the following vote:
