HomeMy WebLinkAbout97-10 EXHIBIT A RESOLUTION NO. 97-10 A RESOLUTION OF THE PLANNING COMMISSION OF 7HE TOWN OF DANVILLE APPROVING A ONE-YEAR TIME EXTENSION FOR A P..'IEVIOUSLY APPROVED DEVELOPMENT PIAN DP 94-17 ALLOWING THE CONSTRUCTION OF A 1,800 +/- SQUARE FOOT COMMERCIAL ADDITION (APN: 199-300-012 -- JOHNSON) WHEREAS, Marianne Johnson has requested approval of a !one-year time extension of a previously approved Development Plan (DP 94-17) allowling for the construction of a 1,800 +/- square foot commercial addition on a 7,500 +/- sq ~are foot site; and WHEREAS, the subject site is located on the west side of Ha.rtz Avenue, at 331-335 Hartz Avenue, and is identified as Assessor's Parcel Number 199-3ยข'}0-012; and WHEREAS, the Town of Danville Downtown Business District Ordinance (Ordinance No. 94-08) allows for not more than two one-year extensions of a Development Plan approval for a commercial addition; and WHEREAS, this extension constitutes the first one-year extension for Development Plan DP 94-17 and extends the valid period of that approval until January 28, 1998; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on March 25, 1997; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending th]at the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider a~l reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of D. time extension for Development Plan DP 94-17 and makes the of this action: tnville approves the one-year Following findings in support Circumstances surrounding the approval of the DevelOpment Plan are substantially PAGE 1 OF RESOLUTION NO. 97-10 , similar to the circumstances under which the Development plan was originally approved.
