RESOLUTION NO. 97-08
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF
DANVILLE RECOMMENDING THAT THE TOWN COUNCIL APPROVE
ZONING TEXT AMENDMENT ZTA 97-01 EXTENDING FOR TWO
ADDITIONAL YEAR PROVISIONS WITHIN ~THE TOWN'S
DOWNTOWN BUSINESS DISTRICT ORDINANCE RELATED
TO THE WAIVER OF PARKING IN-LIEU !FEES AND
AND THE REIAXATION OF LAND USE LIMITATIONS
WHEREAS, the Town of Danville has requested approval Of a Zoning Text Amendment
request ZTA 97-01 to extend for two additional year the effective date of provisions within
the Town's Downtown Business District Ordinance (Ord. Noi 94-08) related the waiver of
parking in-lieu fees and the expansion of allowable uses within ground floor tenant spaces
in Downtown Business Districts 1 and 2; and
WHEREAS, the subject site is identified as the Downtown Business District, containing
Downtown Business Districts 1 thru 9; and
WHEREAS, the Town of Danville's [)owntown Business District Ordinance (Ord. No. 94-08)
requires approval of a Zoning Text Amendment prior to modification of provisions within
the Ordinance; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
February 25, 1997; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a time extension of a previously approved project iis Categorically Exempt from
the requirements of the California Environmental Quality ACt (CEQA); and
WHEREAS, a staff report was submitted recommending!
recommend that the Town Council approve the request; and
that Planning Commission
WHERFAS, the Planning Commission did hear and consider all reports, recommendations,
and testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville recommends approval

of the Zoning Text Amendment ZTA 97-01 and makes the following findings in support of
this action: :
The proposed two-year time extension is consistent with the Danville 2005 General
Plan and the 2005 General Plan and the Downtown Master Plan.

The proposed two-year time extension will help stimulate development and attract
new businesses to downtown Danville.
,
The proposed two-year time extension will provide more flexibility in considering
alternate development proposals.
The proposed two-year time extension will encourage economic growth in Danville.
,
There is no evidence beff~re the Town that the proposed ordinance will have
potential for an adverse effect on wildlife resources or the habitat upon which the
wildlife depends.

1997 by the following vote:
