HomeMy WebLinkAbout97-02 EXHIBIT A RESOLUTION NO. 97-02 A RESOLUTION OF THE TOWN OF DANVILLE PLANNING COMMISSION DENYING WITHOUT PREJUDICE PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 96-07 AND FINAL DEVELOPMENT PIAN - MAJOR SUBDIVISION REQUEST SD 8043 RELATED TO THE DEVELOPMENT OF A 14 UNIT SINGLE FAMILY HOUSING DEVELOPMENT (APN: 2 18-783-001 -- COSTANZO) WHERFAS, W~lliam Costanzo has requested approval of a Preliminary Development Plan - Rezoning and Final Development Plan - Major Subdivision request to rezone a 1.2 +/- acre site from P-l; Planned Unit Development District to a new P-l; Planned Unit Development District and to subdivide the property to allow a 14 unit single family development; and WHEREAS, the subject site is located on the west side of Camino Ramon, south of Greenbrook Drive, and on the east side of Interstate 680, and is identified as Assessor's Parcel Number 218-783-001; and WHEREAS, the Town of Danville P-l; Planned Unit Development District Ordinance requires approval of a Preliminary and Final Development Plan prior to development of the site; and WHEREAS, The Town of Danville Subdivision Ordinance requires approval of a Major Subdivision - Tentative Map application prior to recordation of a final map; and WHEREAS, a Mitigated Negative Declaration of Environmental Significance has been prepared for the project indicating that, as amended through recommended conditions of approval, no significant environmental impacts are expected to be associated with this project; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on January 14, 1997; and PAGE I OF RESOLUTION NO. 97-02 WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Town of Danville Planning Commission denies without prejudice the Preliminary Development Plan - Rezoning request PUD 96-07 and Final Development Plan - Major Subdivision request SD 8043, subject to the conditions contained herein, and makes the following findings in support of this action: Given the location of the subject property and its relationship to surrounding existing developments, the proposed density of the project would lead to a development which is inconsistent and incompatible with surrounding development patterns. , Given the location of the proposed project, the proposed housing units types, and recommended off-site parking restrictions along Camino Ramon, proposed on-site parking will not be adequate and will result in parking impacts within the project and to surrounding neighborhoods. The proposed project lacks central recreational and open space amenities as encouraged by the Town's 2005 General Plan. There is no justification for authorizing the proposed density of the project, near the top of the allowable density range, as the project does not offer counter balancing project amenities, or special improvements or features in return for the proposed density. Project density and design and proposed setbacks from Camino Ramon will create an undesirable "canyon effect" along Camino Ramon.
