HomeMy WebLinkAbout97-01 EXHIBIT A RESOLUTION NO. 97-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DENYING LAND USE PERMIT REQUEST LUP 96-27 TO ALLOW THE KEEPING OF BIRDS, FOWL AND RABBITS AT A SINGLE FAMILY RESIDENCE LOCATED AT 207 RAMONA ROAD (APN: 202-133-005) WHEREAS, Ronald Peterson has requested approval of a Land Use Permit (LUP 96-27) to allow the keeping of birds/fowl and rabbits on a 10,850+ square foot lot; and WHEREAS, the subject site is located on the north side of Ramona Road at 207 Ramona Road and is identified as Assessor's Parcel Number 202-133-005; and WHEREAS, the Town of Danville Single Family Residential District Ordinance (Ordinance No. 43-84) requires approval of a Land Use Permit to keep birds, fowl and rabbits at a single family residential site located in the R-10; Single Family Residential District; and WHEREAS, the proposed project is Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA) (Section 15270); and WHEREAS, the Planning Commission did review the project at a noticed public hearing on January 14, 1997; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission deny the Land Use Permit request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville denies Land Use Permit request LUP 96-27 and makes the following findings in support of this action: 1. The proposed land use is incompatible with the surrounding single family residential neighborhood and is inconsistent with the Danville 2005 General Plan Policy 1.12 that protects existing residential areas from intrusion of incompatible land uses. 2. The proposed keeping of birds, fowl and rabbits is inconsistent with the requirements of the R-10; Single Family Residential District. 3. The proposed continued keeping of birds, fowl and rabbits is a nuisance to the surrounding single family residential neighborhood due to unsanitary conditions, offensive odors, noise, and inadequate containment of the birds, fowl and rabbits. The subject site is inadequately sized to accommodate the number and variety of proposed birds, fowl and rabbits.
