HomeMy WebLinkAbout96-58 EXHIBIT A RESOLUTION NO. 96-58 A RESOLUTION OF THE TOWN OF DANVILLE PlakNNING COMMISSION DENYING AN APPEAL BY NOAH'S BAGELS AND UPHOLDING THE DESIGN REVIEW BOARD'S DENIAL OF SIGN REVIEW REQUEST SR 96-03 WHICH REQUESTS EXCEPTIONS TO THE MASTER SIGN PROGRAM FOR THE TASSAJARA CROSSINGS SHOPPING CENTER (APN: 206-010-046 -- NOAH'S BAGELS) WHEREAS, Noah's Bagels has requested approval of a Sign Review application to allow exceptions to the Master Sign Program at the Tassajara Crossings shopping center; and WHEREAS, the subject site is located at the southeast corner of Camino Tassajara and Crow Canyon Road and is further identified as Assessor's Parcel Number 206-010-046; and WHEREAS, the Town of Danville Sign Ordinance requires approval of an exception to a Master Sign Program for sign proposals which are not consistent with the provisions of the Master Sign Program; and WHEREAS, the Town's Design Review Board denied the Sign Review request on June 19, 1996 and on October 23, 1996; and WHEREAS, the Planning Commission did review the request during a noticed public hearing on January 14, 1997; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission deny the appeal; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Danville Planning Commission denies the appeal and upholds the Design Review Board's denial of Sign Review request SR 96-03 and makes the following findings in support of this action: PAGE I OF RESOLUTION NO. 96-58 The proposed project is not consistent with the previously approved Master Sign Program for the Tassajara Crossings shopping center. No special circumstances or hardships have been identified to justify granting the requested sign exceptions. Granting of the sign exception would be unfair to other tenants within the shopping center who comply with the requirements of the Master Sign Program. The proposed signage is larger than necessary to adequately identify the business and would result in an unfair advantage over other tenants in the shopping center.
