RESOLUTION NO. 96-53
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
DETERMINING GENERAL PLAN CONFORMITY FOR THE TRANSFER OF REAL
PROPERTY IN WEST AIakMO CREEK, ASSESSORS PARCEL NUMBERS 206-010-030,
-037 & -038, FROM THE TOWN OF DANVILLE TO THE CONTRA COSTA COUNTY
FLOOD CONTROL AND WATER CONSERVATION DISTRICT
WHEREAS, Contra Costa County Flood Control and Water Conservation District has
requested that the Town of Danville transfer ownership of a portion of West Alamo Creek
from the Town of Danville to the Contra Costa County Flood Control and Water
Conservation District; and
WHEREAS, the Town of Danville is the owner of the subject properties; and
WHEREAS, said properties lie within West Alamo Creek; and
WHEREAS, the public in general would be best served if ownership lies with the entity most
directly affected by the storm drainage usage of the property; and
WHEREAS, the Town of Danville would retain a landscape easement within ali said
properties within said West Alamo Creek for the use and benefit of the general public; and
WHEREAS, the Town of Danville would retain a trail easements within the northerly most
parcel, for the use and benefit of the general public; and
WHERF~S, Government Code Title 7, Division 1, Chapter 3, Article 7 Subsection 65402
requires that where a General Plan has been adopted, the Planning Agency has the
responsibility for determination of General Plan conformity prior to any disposal of public
land; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
November 26, 1996; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that Planning Commission approve
the request; and
WHERF~S, the Planning Commission did hear and consider all evidence, reports,
recommendations, and testimony submitted in writing and presented at the hearing; now,
therefore, be it
RESOLVED that the Planning Commission of the Town of Danville does herebv determine
that the transfer of real property in West Alamo Creek, assessors parcel numbers 200-010-
030, -037 and -038, from the Town of Danville to Contra Costa County Flood Control and
Water Conservation District is in conformity with the adopted General Plan of the Town of
Danville, and makes the following findings in support of this action:
For General Plan conformance determination, the following goals and policies are
specifically promoted:
Goal 1, Policy 1.11:
Goal 2, Policy 2.02:
Goal 6, Policy 6.03:
Goal 10, Policy 10.02
Goal 10, Policy 10.03
Goal 10, Policy 10.04
Goal 12, Policy 12.01
Goal 12, Policy 12.05
Goal 20, Policy 20.04
...preservation of land for open spaces uses...
...a rational growth management plan which establishes
acceptable levels of service for all infrastructure.., and
provides for the financing and maintenance of these
.... monitoring current and Projected levels of service to
assure that present needs are met ....
Assemble open space areas from contiguous parcels to
.... minimize management problems..
Provide adequate.., interconnecting trail system linking
local park and recreation facilities to each other ....
Public access easements shall be provided.., along creeks
and streams, where appropriate.
Create and maintain a safe, effective system of bikeways
and roadways suitable for bicycle use.
Provide a pleasant and safe environment for pedestrian
movement.
Work in conjunction with County Flood Control to
maintain a natural creek setting to the extent possible
while providing for adequate drainage capacity; and be
it further

RESOLVED, that the Planning Commission does hereby recommend to the DamSlle To~Xm
Council the incorporation of reser-cations for trail easements within the most southerly two
parcels (assessor's parcel numbers 206-101-037 and -038).
APPROVED by the Danville Planning Commission at a Regular Meeting on November 26.
