HomeMy WebLinkAbout96-11RESOLUTION NO. 96-11 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DENYING THE APPF2kL OF AN ADMINISTRATIVE DENIAL OF A REQUEST TO CONSTRUCT A TEMPORARY SECURITY GATE AT THE ENTRY TO PETERS RANCH ESTATES SUBDIVISION (SD 5718) WHEREAS, Peters Ranch Estates has requested approval of a Development Plan (DP 93-17) to allow construction of a temporary security gate for purposes of controlling vehicular access into the development; and WHEREAS, the Planning Commission previously denied a request to install a permanent security gate at the entrance of Peters Ranch Estates Subdivision on March 28, 1995; and WHERF2~S, the applicant requested administrative approval of a temporary steel construction gate at the entrance to Peters Ranch Estates Subdivision; and WHEREAS, the request for administrative approval of the temporary steel construction gate at the entrance to the subdivision was denied October 18, 1995; and WHEREAS, the applicant appealed the administrative decision to deny the gate proposal on December 20, 1995; and WHEREAS, the Planning Commission did review the appeal at a noticed public hearing on February 27, 1996; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission deny the appeal of the administrative action, with this action upholding the administrative action to deny authorization to install the proposed temporary steel construction gate; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville adopts Resolution No. 96-11 denying the appeal of the administrative action to deny authorization to install the proposed temporary steel construction gate and makes the following findings in support of the denial: PAGE NO. 1 OF RESOLUTION 96-11 FINDINGS The proposed security gate is inconsistent with the Danville 2005 General Plan Private Street Policy that discourages gated entries into subdivisions. The proposed "temporary" security gate cannot be considered temporary in nature due to its decorative design and the time period that the gate is expected to remain at the proposed location.
