A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
RECOMMENDING THE TOWN COUNCIL ADOPT A NEGATIVE
DECLARATION OF ENVIRONMENTAL SIGNIFICANCE AND APPROVE
GENERAL PLAN / SPECIFIC PLAN AMENDMENT REQUEST GPA 95-02
(TOWN OF DANVILLE INITIATED REVIEW OF THE CIRCULATION ELEMENT OF
THE OLD BLACKHAWK ROAD SPECIFIC PLAN)
WHEREAS, Steve Condie, representing the Belleterre Owners' Association, requested
that the Town of Danville initiate a General Plan / Specific Plan Amendment Study to
review of the merits of deleting from the Circulation Element of the Old Blackhawk
Road Specific Plan (i.e., the planned secondary vehicular access envisioned to connect
Old Blackhawk Road to Blackhawk Road; and
WHEREAS, this planned secondary access connection was envisioned by the Specific
Plan to also serve as a physical divider of Sub Area 2 of the Specific Plan (Residential
Single Family - Low Density 1-3 dus/ac) and Sub Area 3 of the Specific Plan
(Residential - Single Family - Medium Density 4-7 dus/ac) and to provide access to
shopping and office development located in vicinity of the intersection of Crow
Canyon Road and Camino Tassajara; and
WHEREAS, on November 8, 1995 the Town Council of the Town of Danville initiated
the requested General Plan / Specific Plan Amendment Study and directed staff to
preform said study; and
WHERF~S, the Town Council further directed staff to develop a recommended cost
recovery plan with allocation of responsibility of payment of the pertinent general plan
amendment study fee (i.e., $3,165) to benefiting properties within the General Plan /
Specific Plan Study Area (i.e., properties adjoining, or in close proximity to, the subject
roadway); and
WHEREAS, the Planning Commission did review the request at a noticed public
hearing on December 12, 1995; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
recommend that the Town Council adopt a Negative Declaration of Environmental
Significance for the proposal and approve General Plan / Specific Plan Amendment
request GPA 95-02, amending the Circulation Element of the Old Blackhawk Road
Specific Plan to eliminate the secondary vehicular access into the Plan Area; now,
therefore, be it

RESOLVED that the Planning Commission of the Town of Danville recommends the
Town Council of the Town of Danville adopt a Negative Declaration of Environmental
Significance and approve General Plan / Specific Plan Amendment request GPA 95-02,
as recommended by staff, amending the Circulation Element of the Old Blackhawk
Road Specific Plan to eliminate the secondary vehicular access into the Plan Area; and,
be it further
RESOLVED that the Planning Commission makes the following findings in support of
this recommendation:
The proposed deletion of the planned secondary vehicular access envisioned to
connect Old Blackhawk Road to Blackhawk Road is consistent with the Goals
and Policies of the Danville 2005 General Plan and the Old Blackhawk Road
Specific Plan.
The General Plan / Specific Plan Amendment will not adversely affect the
Town's ability to maintain high-quality public facilities and services.
The General Plan / Specific Plan Amendment will not adversely affect the
preservation of present aesthetics and other community qualities.
The General Plan / Specific Plan Amendment will not adversely affect the quality
of life within existing developed areas of the community.
The General Plan / Specific Plan Amendment will not adversely affect the
harmony between Danville's development and its physical setting.
APPROVED by the Danville Planning Commission at a Regular Meeting on December
12, 1995, by the following vote:
