RESOLUTION NO. 95-25
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
APPROVING A REQUEST FOR A TIME EXTENSION FOR LUP 89-05 ALLOWING
THE RESIDENTIAL USE OF A MOBILE HOME AT 433 ~TOS DRIVE (BAKER)
(APN: 198-241-011)
WHEREAS, Edward J. Baker has requested approval of a three year extension of time
for Land Use Permit LUP 89-05 to allow an existing mobile home to remain on a .40
acre site; and
WHEREAS, the subject site is located at 433 Alamatos Drive and is identified as
Assessor's Parcel Number 198-241-011; and
WHEREAS, the Town of Danville R-15; Single Family Residential District Ordinance
requires approval of a Land Use Permit to allow residential use of a mobile home; and
WHEREAS, The Zoning Ordinance grants the Planning Commission authority to
approve Land Use Permit time extensions; and
WHEREAS, the conditions upon which previous extensions of time have been granted
have not changed; and
WHEREAS, the Planning Commission did review the project at a noticed public
hearing on August 8, 1995; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
now, therefore be it
RESOLVED that the Planning Commission of the Town of Danville approves a five year
time extension for LUP 89-05 per the conditions contained herein, and makes the
following findings in support of the extension of time:
The proposed land use will not be detrimental to the to the health, safety, and
general welfare of the Town.

The land use will not adversely affect the orderly development of property
within the Town.

The land use will not adversely affect the preservation of property values and
the protection of the tax base within the Town.
The land use will not adversely affect the policy and goals as set by the General
Plan.
The land use will not create a nuisance and~or enforcement problem within the
neighborhood or community.
Thc land use will not encourage marginal development within thc
neighborhood.
CONDITIONS OF APPROVAL
The subject land use permit is extended to April 24, 2000. Any future time
extension requests may be processed administratively.
2. The use shall comply with all previous Conditions of Approval for LUP 89-05.
APPROVED by the Danville Planning Commission at a Regular Meeting on August 8,
1995 by the following vote:
