RESOLUTION NO. 95-08
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
DENYING AUTHORIZATION TO CONSTRUCT A SECURITY GATE AT THE ENTRY
TO PETERS RANCH ESTATES SUBDIVISION (SD 5718)
WHERF~S, Peters Ranch Estates has requested approval of a Development Plan (DP
93-17) to allow construction of a security gate for purposes of controlling vehicular
access into the development; and
WHEREAS, the Planning Commission did review the project at a noticed public
hearing on March 28, 1995; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHERF~S, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
now, therefore, be it
RESOLVED THAT the Planning Commission of the Town of Danville adopts
Resolution No. 95-08 denying the proposed security gate and makes the following
findings in support of the denial:
FINDINGS
The proposed security gate is inconsistent with the Danville 2005 General Plan
Private Street Policy that discourages gated entries into subdivisions.
There is no evidence to support the need for a permanent security gate because
none of the twelve single family residential subdivision lots have been
developed, therefore the request for a security gate is premature and
unwarranted at this time.
It is anticipated that after buildout of the subdivision, the existing nuisance
issues will not exceed those experienced by other neighborhoods within the
Town of Danville.
