HomeMy WebLinkAbout95-07 EXHIBIT A RESOLUTION NO. 95-07 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE FINDING THAT THE AQUISITION OF A 39.7 ACRE PARCEL (APN St 199-090-006) BY THE EAST BAY REGIONAL PARK DISTRICT IS IN CONFORMANCE WITH THE DANVILLE 2005 GENERAL PLAN WHEREAS, the East Bay Regional Park District (EBRPD) intends to acquire a 39.7 acre site from the existing property owner (Dura Constructors, Inc.); and WHEREAS, Government Code Section 65402 requires that the Town of Danville make a determination that acqusition of this 39.7 acre site by EBRPD is in conformance with the Town of Danville 2005 General Plan; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on March 28, 1995; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHERF~S, a staff report was submitted recommending that Planning Commission make the determination that acquisition of this 39.7 acre site by EBRPD is consistent with the goals and policies of the Danville 2005 General Plan; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville makes the following findings; The proposed acquisition of 39.7 acres by EBRPD from the property owner (Durs Constructors, Inc.) is consistent with the goals and policies of the Town of Danville 2005 General Plan. This action is exempt from the requirements of the California Environmental Quality Act (CEQA).
