RESOLUTION NO. 94-33
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
DENYING REQUESTS FOR A LAND USE PERMIT (LUP 94-11) AND VARIANCE
(VAR 94-32) TO CONSTRUCT A 286+ SQUARE FOOT SECOND LIVING UNIT 11
FEET FROM THE REAR YARD PROPERTY LINE - RATFIELD
WHEREAS, Tod Rarfield has requested approval to construct a 286+ square foot
second dwelling unit on a .63+ acre site; and
WHEREAS, the subject site is located at 351 La Questa Drive and is identified as
Assessor's Parcel Number 216-151-015; and
WHEREAS, the Town of Danville R-20; Single Family Residential Zoning District
Ordinance requires approval of a Land Use Permit to allow the establishment of a
second dwelling unit; and
WHEREAS, the Planning Commission did review the project at a noticed public
hearing on November 8, 1994; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town
of Danville denies the Land Use Permit and Variance requests (LUP 94-11 & VAR 94-
32) and makes the following findings in support of this denial:
An eleven foot rear yard setback for the proposed second dwelling unit will
adversely impact the privacy of surrounding properties.

There are alternative locations on the site where a second dwelling unit can be
constructed consistent with structural setback requirements for the R-20; Single

Family Residential Zoning District.
The magnitude of the proposed variance will create a negative precedence for
neighborhoods in the R-20; Single Family Residential Zoning District.
APPROVED by the Danville Planning Commission at a Regular Meeting on November
8, 1994, by the following vote:
