HomeMy WebLinkAbout94-25EXHIBIT A RESOLUTION NO. 94-25 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING A LAND USE PERMIT EXTENSION (LUP 90-11) ALLOWING OUTDOOR STORAGE OF BUILDING MATERIALS FOR DANVILLE LUMBER & DECORATING WHEREAS, DeWayne Ryan has requested approval of a Land Use Permit for outdoor storage of building materials for Danville Lumber & Decorating at Danville Square Shopping Center; and WHEREAS, the subject site is located at 21 Danville Square Shopping Center, and is identified as Assessor's Parcel Number 19%330~024; and WHEREAS, the Town of Danville Downtown Business District Ordinance Area 4; Residential Serving Commercial, requires approval of a Land Use Permit for outdoor storage; and WHEREAS, a temporary Land Use Permit was approved on September 25, 1990 allowing outdoor storage at the site for an 18 month period; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on August 23, 1994; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHERF~S, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves the Land Use Permit extension per the conditions contained herein, and makes the following findings in support of the Land Use Permit extension: The proposed development is consistent with the General Plan and with the Downtown Business District Ordinance: Area 4; Residential Serving Commercial. The development will be an attractive and efficient center which will fit harmoniously into and will have no adverse effects upon the adjacent or surrounding development. PAGE 1 OF RESOLUTION NO. 94-25 The use will not adversely affect the orderly development of property or encourage marginal development within the respective land use district in which the subject property is located. The use will not adverselY affect the preservation of property values and the protection of the tax base within the Town. o The use will not create a nuisance and/or enforcement problem within the neighborhood. CONDITIONS OF APPROVAL * 1. This approval is for outdoor storage of building materials identified as LUP 90-11. Development shall be substantially as shown on the project drawings as follows, except as may be modified by conditions contained herein; Preliminary Site/Circulation Plan consisting of one sheet, as prepared by Dahlin Group and dated received by the Planning Division on August 11, 1994. 0 All of the requirements of the San Ramon Valley Fire Protection District shall be met. All lighting shall be installed in such a manner that glare is directed away from surrounding properties and right-of-ways. This Land Use Permit is approved with no expiration date. Conditions of Approval contained within this resolution supersede those contained in Resolution No. 90-46. The circulation pattern for truck deliveries and customer pick-up shall require vehicles to enter the site from Linda Mesa and exit through the shopping center parking lot onto Railroad Avenue. When the site at the southwest corner of Railroad Ave. and Love Lane is developed, Danville Lumber & Decorating deliveries and customer traffic shall exit onto Love Lane consistent with the circulation plan specified in Condition 1.a. Modifications to the existing driveway may require relocating materials and storage structures on the subject site: PAGE 2 OF RESOLUTION NO. 94-25 Loading and unloading of materials shall take place only within the fenced storage area. Truck deliveries shall be limited to the hours of 7:00 a.m. to 4:30 p.m. Mondays thru Friday. o 10. 11. 12. 13. 14. Building materials located in the fenced outdoor storage area shall not exceed 12 feet in height. The existing outdoor display area adjacent to the shopping center parking lot shall not be expanded or modified without the review and approval of the Chief of Planning. Upon development of the adjacent site located at the southwest corner of Love Lane and Railroad Ave., the outdoor display area located adjacent to the shopping center shall be modified consistent with the revised circulation plan for the shopping center. The applicant shall submit a design, including products to be displayed for the review and approval of the Chief of Planning prior installation. Items permitted to be displayed in the outdoor display area are as follows: storage sheds, play equipment, fencing displays, decks and other related products subject to the review and approval of the Chief of Planning. Traffic directory signs placed at the Linda Mesa Ave. driveway entrance and the exit into the shopping center parking lot shall be maintained at all times. Customers shall be directed to exit the site at Railroad Ave until the southwest corner of Railroad Ave. and Love Lane is developed. Prior to development of the corner site, signs shall be installed to indicate that customers and deliveries are to exit onto Railroad Ave. subject to the review and approval of the City Engineer. This permit does not authorize access to the driveway providing access to Love Lane. All signs not authorized by the Town of Danville shall be removed from the site; including but not limited to: the "Benjamin Moore Paint" sign located on thc wall of the building. The display of temporary banners shall conform to the requirements of the Danville Sign Ordinance. 16¸ All existing trees on the site shall be preserved to the extent practical. Removal will be allowed only upon prior written approval from the Planning Division. The modified outdoor display area adjacent to the shopping center parking lot shall not negatively impact the existing 18 inch diameter Valley Oak.
