HomeMy WebLinkAbout94-23 EXHIBIT A RESOLUTION NO. 94-23 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DENYING THE APPEAL OF THE TOWN'S ADMINISTRATIVE APPROVAL WHEREAS, Richard Oas has appealed a Town of Danville administrative decision allowing an installed brick veneer to remain as a substitute for the previously approved stone veneer on one model home in the Hidden Valley residential project; and WHERF~S, the subject site is located on the southwest corner of McCauley Road and Grado Ct. and is identified as Assessor's Parcel Number 202-363-005 and is further identified as Lot 43 of SD 6886; and WHEREAS, the Town of Danville Municipal Code Section 1-8 allows for the appeal of an administrative action taken by a Town officer or employee; and WHEREAS, on June 8, 1994 the Town's Planning Division took action administratively approving the use of an incorrectly installed brick veneer in lieu of the approved rock veneer on a model home for the Summit Collection at the Hidden Valley residential housing project; and WHEREAS, on June 28, the Town received an appeal of this administrative action from Rich Oas, a Hidden Valley resident; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on July 26, 1994; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission deny the appeal; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville denies the appeal and makes the following findings in support of this action: The change to the front elevation of the subject unit is substantially consistent with the previous architectural approval. The change to the front elevation of the subject unit will not be repeated elsewhere in the project and therefore will not lead to a substantial change in the character of the overall project. The change to the front elevation of the subject unit does not substantially conflict with the P-l; Planned Unit Development District in which the project is located.
