HomeMy WebLinkAbout93-41 EXHIBIT A RESOLUTION NO. 93-41 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING A SIGN EXCEPTION FOR AN INTERNALLY ILLUMINATED GROUND SIGN FOR BRIDGES RESTAURANT AT 448 HARTZ AVENUE WHEREAS, Bridges Land Co has requested approval of a exception to the Sign ordinance for a internally illuminated ground sign on a .27 acre site: and WHEREAS, the subject site is located on the northeast corner of Hartz Avenue and Church Street, at 448 Hartz Ave and is identified as Assessor's Parcel Number 208-022- 046; and WHERF~S, the Town of Danville Sign Ordinance requires approval of a sign exception to allow internally illuminated signs in Area 1 of the Downtown Business District; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on October 12, 1993; and WHEREAS, the public notice of this action was given in all respects as required by law: and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHERF~S, the Planning Commission did hear and consider all reports. recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves the grant of the Sign Exception per the conditions contained herein. and makes the following findings in support of the request: 1. The proposed project is consistent with the Danville 2005 General Plan. There is no evidence before the Town that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. PAGE 4 RESOLUTION NO. 93-41 o There has previously been a sign exception granted for the existing sign at this location. The proposed sign will replace the existing sign and conform as closely as practicable to the regulations pertaining to the sign size, number, and location: and o The proposed sign is aesthetically attractive and is not inconsistent with the intent and purpose of the sign regulations; and The restaurant is not primarily visible from the street and the sign is located in a landscaped park setting. Internal (halo) illumination is appropriate to provide the necessary visibility for the sign. Strict adherence to the sign regulations does not allow adequate identification of the business. CONDITIONS OF APPROVAL (Note: * Indicates standard project Conditions of Approval) Unless otherwise specified, the fbllowing Conditions shall be complied with prior to issuance of a building permit for the project. Each item is subject to review and approval by the Planning Division unless otherwise specified. A. GENERAL This approval is for a exception to the Sign Ordinance for a twenty square foot internally illuminated ground sign. Development shall be substantially as shown on the project drawings as follows, except as may be modified by conditions contained herein; Sign elevation and details prepared by Thomas Swan Sign Company dated received by the Danville Planning on October 8, 1993. The developer shall pay any and all Town and other related fees that the property may be subject to. These fees shall be based on the current fee schedule in effect at the time the relevant permits are secured. The existing landscaping shall be retained and kept in a healthy growing condition.
