HomeMy WebLinkAbout93-37EXHIBIT A RESOLUTION NO. 93-3'7 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE FINDING THAT THE TRANSFER OF A 0.02 ACRE PARCEL BY THE EAST BAY MUNICIPAL UTILITY DISTRICT IS IN CONFORMANCE WITH THE DANVILLF. 2005 GENERAL PLAN WHEREAS, the East Bay Municipal Utility District (EBMUD) intends to transfer a 0.02 acre site identified by Assessors Parcel #199-050-003; and WHEREAS, Government Code Section 65402 requires that the Town of Danville make a determination that the transfer of this 0.02 acre site by EBMUD is in conformance with the Town of Danville 2005 General Plan; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on September 14, 1993; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission make the determination that the transfer of this 0.02 acre site is consistent with the goals and policies of the Danville 2005 General Plan; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville makes the following findings; The proposed transfer/sale of 0.02 acres by EBMUD is consistent with the goals and policies of the Town of Danville 2005 General Plan. This action is exempt from the requirements of the California Environmental Quality Act (CEQA).
