A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
INDICATING GOVERNMENT CODE 65402 FINDINGS OF DETERMINATION
PERTAINING TO THE PROPOSED PURCHASE OF THE DANVILLE LIBRARY SITE
BY THE DANVILLE COMMUNITY DEVELOPMENT AGENCY
WHEREAS, it is envisioned that in conjunction with the redevelopment of the 10.25_ acre
Charlotte Wood School site fronting on Hartz Way and Front Street, a new Danville
Branch Library will be constructed, rendering the existing library facility at 825 Hartz Way
a surplus government property; and
WHEREAS, Government Code Section 65402 establishes a requirement that prior to the
disposal of real property owned by a governmental entity, the planning agency shall make
the necessary findings that such a sale is in conformance with the pertinent general plan;
and
WHEREAS, the Danville Community Development Agency is pursuing the purchase of the
existing library site, which would remain in use until the replacement library facility was
constructed, through an expenditure of redevelopment agency housing funds; and
WHEREAS, purchase of the site would be in anticipation of redevelopment of the
25,0754- sf (0.576 acres) site with affordable housing; and
WHEREAS, the sale of surplus government land is exempt from the provisions of the
California Environmental Quality Act (CEQA); and
WHEREAS, prior to a commitment being formalized to redevelop the existing library site
with affordable housing, detailed plans will be prepared and subjected to general plan
and rezoning review, as well as separate environmental review under the provisions of
CEQA; and
WHEREAS, the Planning Commission did consider the matter at a noticed public hearing
on May 11, 1993; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHERF~S, a staff report was submitted recommending that Planning Commission make
a determination of 65402 compliance, thereby facilitating the sale of the property from
Contra Costa County to the Danville Community Development Agency; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing, now,
therefore, be it;
RESOLVED that the Planning Commission of the'Town of Danville has affirmatively
determined 65402 compliance for the proposed sale of property from Contra Costa
County to the Danville Community Development Agency 65402 compliance, thereby
facilitating the development of affordable units required under California Redevelopment
Law; and
APPROVED by the Danville Planning CommiSsion at a Regular Meeting on May 11,
1993, by the following vote:
