HomeMy WebLinkAbout93-15 EXHIBIT A RESOLUTION NO. 93-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING AN AUTO BROKERAGE AT 158 LINDA MESA STREET WHEREAS, Terri Davies has requested approval of a Land Use Permit to establish an auto brokerage; and WHERF~S, the subject site is located at 158 Linda Mesa Street; and is identified as Assessor's Parcel Number 199-330-016; and WHEREAS, the Town of Danville [)BI); Downtown Business District Ordinance requires approval of a Land Use Permit to establish an auto brokerage in Area 4 of the Downtown Business District; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on March 23, 1993; and XVHERFakS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHERF~S, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves LUP 93-06 per the conditions contained herein, and makes the following findings in support of the Land Use Permit: 1. The proposed project is consistent with the Danville 2005 General Plan. 0 There is no evidence before the Town that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. The proposed land use will not be detrimental to the to the health, safety, and general welfare of the Town. PAGE 1 OF RESOLUTION NO. 93-15 The land use will not adversely affect the orderly development of property within the Town. The land use will not adversely affect the preservation of property values and the protection of the tax base within the Town. The land use will not adversely affect the policy and goals as set by the General Plan. The land use will not create a nuisance andNor enforcement problem within the neighborhood or community. 8. The land use will not encourage marginal development within the area. Tandem parking is allowed in this commercial area in order to display vehicles for the auto brokerage and therfore will not cause an unsafe or inefficient traffic movements on the subject site. CONDITIONS OF APPROVAL This approval is for an auto broker identified as Diablo Valley Auto Brokers. Development shall be substantially as shown on the project drawings as follows, except as may be modified by conditions contained herein; Unlabeled site plan for 158 Linda Mesa Street dated received March 3, 1993. b. Staff striping plan, dated March 18, 1993. o The developer shall pay any and all Town and other related fees that the property may be subject to. These fees shall be based on the current fee schedule in effect at the time the relevant permits are secured. The applicant shall submit to the Town of Danville fees required to file a Notice of Determination for this project as required by AB 3185. The fee shall be $1,300 unless the project is found to be De Minimus (the project has no potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends), in which case the fee shall be $25.00. PAGE 2 OF RESOLUTION NO. 93-15 10. 11. All lighting shall be installed in such a manner that glare is directed away from surrounding properties and rights-of-way. The street number(s) of the building(s) shall be posted so as to be easily seen from the street at all times, day and night. All parking spaces shall be striped at 9'x 19'. The project shall be constructed as approved. Minor modifications in the design, but not the use, may be approved by Staff. Any other change will require Planning Commission approval through the Development Plan review process. Striping of the leased parking area shall be completed and if possible, the tenant shall also work with the landlord to stripe parking spaces #10-#16 in the staffs striping plan dated March 18, 1993. Six parking stalls shall be provided for the building where the subject auto brokerage is located. The parking lot striping shall be reviewed and approved by Planning staff and implemented prior to operation of the auto brokerage activity at the proposed location. A maximum of two signs are approved for the subject use; one eave sign located on the south (Linda Mesa Street) elevation not to exceed six sq. ft. and one door sign not to exceed two sq. ft. located on the east elevation of the auto brokerage. All sign sizes, materials, designs and locations shall be subject to review and approval by the Planning Division. This Land Use Permit is for the Diablo Valley Auto Brokers for outdoor display of a maximum of three vehicles for sale. If the applicant wishes to expand the number of vehicles permitted under this permit, a written application and parking lot striping plan must be submitted for review and approval by the Planning Division prior to expansion of the use. No flags, signs, or other devices commomnly used at car sles lots to attract the public's attention shall be allowed on sight. One 12"x 12" sign and any other State mandated signs may be located in the window of each vehicle. PAGE 3 OF RESOLUTION NO. 93-15 12. Only moter cycles, passenger cars and pick-ups may be displayed for sale on the premise. No RVs, oversized trailers, large trucks, boats, etc. shall be displayed for sale on the premise.
