HomeMy WebLinkAbout93-02 EXHIBIT A RESOLUTION NO. 93-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DENYING INSTALLATION OF A GATED ENTRY IN THE WESTBRIAR KNOLLS SUBDIVISION WHEREAS, Gregory Group has requested approval of a Development Plan for a security gate at the Westbriar Knolls subdivision; and WHEREAS, the subject site is located at the intersection of La Gonda Way and El Pintado Road and is identified as Assessor's Parcel Number 200--281-005 (Parcel A); and WHEREAS, the Town of Danville P-l; Planned Unit Development District Ordinance requires approval of a Development Plan; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on January 26, 1993; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission deny the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville denies the security gate request and makes the following findings in support of the denial: 1. The proposed project is inconsistent with the policy of the Danville Town Council regarding gated communities. 2. No precedent exists regarding allowing such a request and this entitlement would establish precedent in Danville. 3. The subject subdivision is under construction and lots are being marketed to the public; as a result, these promotional activities may be interfering with the normal traffic flow to the site, therefore the request may be premature and unwarranted at this time. 4. The Town of Danville and the developer have taken steps to minimize the impact of traffic in the subdivision, but adequate time has not been given to see if these solutions will solve the problem. 5. It is anticipated that after the sales office is closed, and the flags and signs are taken down, the existing nuisance issues will not exceed those experienced by other neighborhoods within the Town.
