HomeMy WebLinkAbout92-45TOWN OF DANVILLE RESOLUTION NO. 92-45 COUNTY RESOLUTION NO. 67-1992 JOINT RESOLUTION OF THE DANVILLE PLANNING COMMISSION, TOWN OF DANVILLE AND SAN RAMON VALLEY REGIONAl. PLANNING COMMISSION, COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA, REGARDING THE ALAMO SPRINGS PROJECT FOR THE ALAMO/DANVILLE AREA OF CONTRA COSTA COUNTY WHEREAS, on May 12, 1989, and July 12, 1989 the County of Contra Costa and Town of Danville respectively received petitions from New West Federal Savings and Loan requesting that a study be undertaken to amend the respective General Plan of each jurisdiction for a 148-acre property, a portion of which lay within the unincorporated area of Contra Costa County and a portion within the Town of Danville; and WHEREAS, on August 7, 1989 the Danville Town Council and Contra Costa County Board of Supervisors entered into a Memorandum of Agreement (MOA) for the Alamo Springs project: authorize a review of the General Plan Amendment request submitted by New West Federal Savings and LOan; for the purpose of satisfying the California Environmental Quality Act, the MOA designated the County of Contra Costa to serve as the Lead Agency and the Town of Danville to serve as a Responsible Agency; said MOA also provided for the establishment of an hoc Alamo Springs Coordinating Committee with two appointed representatives from each jurisdiction; the role'of the Committee is to try to resolve any differences in the respective positions of the County and Town in the development review process; and WHEREAS, on January 8, 1990 concurrent application requests were filed with the Town of Danville by New West Federal Savings and Loan/American Real Estate Group (applicant and Owner) to rezone 30 acres from R-100: Single Family Residential District and A-2: General Agricultural District to P-l: Planned Unit Development District; and for approval of a Preliminary and Final Development Plan and Vesting Tentative Map applications for 101 residential units and lots, and common open area (File #PUD 90-1, SD 7453); and WHEREAS, on January 17, 1990 concurrent application requests were filed with the Contra Costa County Community Development Department by New West Federal Savings and Loan/American Real Estate Group (Applicant and Owner) to rezone 118 acres from General TOWN OF DANVILLE RESOLUTION NO. 92-45 COUNTY RESOLUTION NO. 67-1992 Agricultural (A-2) to Planned Unit District (P-l); and for approval of Preliminary and Final Development Plan and Vesting Tentative Map applications for a 101-unit residential unit and lots, and common open space development (File #2882-RZ, File #3003-90, SUB 7452); and WHEREAS, on March 12, 1990 the County Community Development Department circulated a Notice of Preparation of Intent to prepare an Environmental Impact Report (EIR) for the Alamo Springs project to responsible agencies and other potentially interested parties, soliciting input from the public on'the appropriate scope of work for the EIR; and WHEREAS, on June 14, 1991 the County Community Development Department circulated a Notice of Completion of the Alamo Springs Draft EIR to potentially interested parties; and WHEREAS, after notice was lawfully given, on July 31,1991, the San Ramon Valley Regional Planning Commission of the County of Contra Costa and the Danville Planning Commission of the Town of Danville conducted a joint public hearing to take testimony on the adequacy of the Alamo Springs Draft EIR; and · WHEREAS, on November 14, 1991, following closure of the public comment period, the San Ramon Valley Regional Planning Commission unanimously voted its intent to recommend to the Board of Supervisors of the County of Contra Costa to certify the adequacy of the Alamo Springs Final Environmental Impact Report, constituting the Draft EIR and Responses-to- Comments document; and WHEREAS, after notice was lawfully given on June 17, 1992, the San Ramon Valley Regional Planning Commission of the County of Contra Costa and the Danville Planning Cbmmission of the Town of Danville conducted'a joint public hearing to take testimony on the proposed General Plan Amendment, Rezoning and Preliminary Development-Plan and provided direction for resubmittal to the staff and applicant; and WHEREAS, on August 21, 1992, New West Federal Savings and Loan/American Real Estate Group (Applicant/Owner) submitted concurrently to the Town of Danville and the Contra Costa Community Development Department a revised Preliminary and Final Development Plan and a Vesting Tentative Map for 75 residential units and lots as a replacement for their 101 residential units and lots application; and WHEREAS, after review of the Applicant/Owner resubmittal, the joint staffs recommended revisions to the plan to eliminate visibility of units from the surrounding community, and provide useable building pads and limit development to a maximum of 58 units; and WHEREAS, after notice was lawfully given, the Danville Planning Commission and San Ramon Valley Regional Planning Commission resumed their continued joint public hearing on the Alamo Springs project on October 14, 1992, whereat all persons interested therein might 2 TOWN OF DANVILLE RESOLUTION NO. 92-45 COUNTY RESOLUTION NO. 67-1992 appear and be heard; and at the conclusion of which the hearing was closed and the project continued for decision; and WHEREAS, on November 4, .1992, the applicant submitted another revised :site plan further reducing the proposed project to 59 lots; and WHEREAS, the Danville Planning Commission and San Ramon Valley Regional Planning Commission having fully reviewed, considered and evaluated all testimony and evidence on this matter. NOW, THEREFORE, BE IT RESOLVED that the San Ramon Valley Regional Planning Commission recommends that the Contra Costa County Board of Supervisors certify the adequacy of the Alamo Springs Final Environmental Impact Report; and BE IT FURTHER RESOLVED that the San Ramon Valley Regional Planning Commission respectively recommends to the County Board of Supervisors and the Danville Planning Commission respectively recommends to the Danville Town Council: · ADOPTION of the Alamo Springs General Plan Amendment as shown on Exhibit I; APPROVAL of County Rezoning File #2822-RZ and Danville Rezoning File #PUD 90-1 to rezone the site to Planned Unit District (P-l); and APPROVAL of Preliminary and Final Development Plans and Vesting Tentative Maps for a maxim,urn of 58 units subject to the conditions contained in Exhibit II; and · ADOPTION of project-related findings as contained in Exhibit II. The decision of the San Ramon Valley Regional Planning Commission recommending certification of the adequacy .of the Alamo Springs Final EIR and recommending approval of the General Plan Amendment, Rezoning and Preliminary and Final Development Plan and Vesting Tentative Map applications was given by motion of the San Ramon Valley Regional Planning Commission on Tuesday, November 10, 1992, by the following vote: AYES: Commissioners - Kaye, Auch, Matsunaga, Naidorf, and Moore. NOTES: Commissioners - Jones. ABSENT: Commissioners - Cameron. ABSTAIN: Commissioners - None. 3 TOWN OF DANVILLE RESOLUTION NO. 92-45 COUNTY RESOLUTION NO. 67-1992 The decision of the Danville Planning Commission to recommend approval of the General Plan Amendment, Rezoning and Preliminary and Final Development Plan and Vesting Tentative Map applications was given by motion of the Danville Planning Commission on Tuesday, November 10, 1992, by the following vote: AYES: Commissioners - Arnerich, Hunt, Hughes and Osborn. NOES: Commissioners - Wright. ABSENT: Commissioners - Vilhauer and Murphy. ABSTAIN: Commissioners - None. BE IT FURTHER RESOLVED that the respective Chairs and Secretaries of the Danville Planning Commission and San Ramon Valley Regional Planning Commission shall respectively sign and attest the certified copy of this resolution and deliver the same to the County Board of Supervisors and Danville Town Council all in accordance with the Planning Laws of the State of California. RD 12/2/92 5 EXHIBIT I ALAMO SPRINGS GENERAL PLAN AMENDMENT Recommended Changes to the 1991 County General Plan and 1987 Danville General Plan To integrate the Alamo Springs General Plan Amendment into the Countywide General Plan and into the Danville General Plan, the land use element maps of both respective plans shall be changed to reflect the Open Space and Single Family Residential-Low Density for the 148-acre amendment area. The boundaries of the recommended change are shown in Figure I. A new policy will be added to page 3-70 of the County General Plan and to page 51.a. of the Danville General Plan to read as follows: Development of the Alamo Springs property which is adjacent to Interstate 680 at the ends of La Gonda Way and Los Balcones Drive in the Alamo/Danville area shall be limited to a maximum of 58 single family residential units. Primary vehicular access shall be from La Gonda Way. Open Space lands shall be deed restricted to Contra Costa County and the Town of Danville and maintained as a project buffers, fire breaks, permanent private and/or public open space and publicly- accessible trails. Active or passive project recreation facilities may also be permitted in certain portions of this designation. The residential designation provides for a maximum of 58 dwelling units. The boundaries are generalized but encourage development within the previously graded areas of the ridgetop and generally preclude development that would be visible from adjacent valley floors. Development shall be designed to maximize protection of existing mature Valley Oaks on site, including those trees in proximity to proposed development.
