HomeMy WebLinkAbout92-44 EXHIBIT A RESOLUTION NO. 92-44 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING A ONE YEAR EXTENSION OF TIME FOR TENTATIVE MAP MS 860-89 (APN: 200-020-022 & 200-020-023 -- MERTA) WHERF~S, Dan and Charlene Merta have requested approval of a one year extension of previously approved Tentative Map MS 860-89, a three parcel Minor Subdivision of two existing parcels totaling approximately 4.37 acres; and WHEREAS, the subject site is located on the east side of E1 Pintado Road at 911 & 923 E1 Pintado Road, and is identified as Assessor's Parcel Number 200-020-022 & 200-020-023; and WHEREAS, the Town of Danville Subdivision Ordinance allows for a maximum of three one-year extensions of a Tentative Map approval; and WHERF~S, this approval comprises the first one-year extension, extending the approval period of the Tentative Map MS 860-89 until October 17, 1993; and WHERF~S, the Planning Commission did review the project at a noticed public hearing on December 8, 1992; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves a one-year extension of time for Tentative Map MS 860-89 and makes the following findings in support of this action: The proposed subdivision is in substantial conformance with the goals and policies of the General Plan. o The design of the proposed subdivision is in substantial conformance with the applicable zoning regulations. 3. The design of the subdivision and the type of associated improwements will not PAGE 1 OF RESOLUTION NO. 92-44 o likely cause serious public health problems. The density of the subdivision is physically suitable for the proposed density of development. The design of the proposed subdivision and improvements are not likely to cause substantial environmental damage or subsequently injure fish or wildlife or their habitat since this property is in an area where residential development has previously occurred. The design of the proposed subdivision and proposed improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. The Minor Subdivision will not be injurious to public health, safety, or general welfare, or be inconsistent with existing Town ordinances or policies.
