HomeMy WebLinkAbout92-36 EXHIBIT A RESOLUTION NO. 92-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING CUSTOM HOME DESIGN GUIDELINES FOR LOTS 29-42 OF SD 7035 WHERF~S, The Gregory Group has requested approval of a Revised Final Development Plan for 14 lots (lots 29-41) at the Westbriar Knolls subdivision; and WHEREAS, the subject site is located west of the intersection of La Gonda Way and El Pintado, on Meadowside Place and is identified as Assessor's Parcel Number 200-282-001 thru 004, 200-281-029 thru 038; and WHEREAS, the Town of Danville P-l; Planned Unit Development District Ordinance requires approval of a Development Plan for changes in project architecture; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on September 29, 1992; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves DP 92-13 per the conditions contained herein, and makes the following findings in support of the Development Plan: The proposed project is consistent with the Danville 2005 General Plan. The proposed changes to the previously approved development plan are consistent with the intent and purpose of the P-1 District and compatible with other uses in the vicinity. There is no evidence before the Town that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which thc wildlife PAGE 1 OF RESOLUTION NO. 92-36 depends. 4. The applicant intends on starting construction within two and one half years. o The project will constitute a residential environment of sustained desirability and stability; and will be in harmony and character with the surrounding neighborhood. 0 The development of a harmonious, integrated plan justifies exceptions from the normal application of the code. CONDITIONS OF APPROVAL (Note: * Indicates standard project Conditions of Approval) Unless otherwise specified, the following Conditions shall be complied with prior issuance of a building permit for the project. Each item is subject to review and approval by the Planning Division unless otherwise specified. A. GENERAL This approval is for revised architecture for lots 29 thru 42 of SD 7035 Westbriar Knolls. Development shall substantially comply with the Westbriar Knolls Custom Lot Design Guidelines, dated received by the Planning Division September 21, 1992, except as may be modified by conditions contained herein. * 2. * 3. * 4. The developer shall pay any and all Town and other related fees that the property may be subject to. These fees shall be based on the current fee schedule in effect at the time the relevant permits are secured. Notice should be taken specifically of the Town's Transportation Improvement Program (TIP) fee, Park Dedication Fee and the drainage acreage fees as established by the Contra Costa County Flood Control District. Prior to the issuance of grading or building permits, the developer shall submit written documentation that all requirements of the San Ramon Valley Fire Protection District and the San Ramon Valley Unified School District have been or will be, met to the satisfaction of these respective agencies. The applicant shall submit to the Town of Danville fees required to file a Notice of Determination for this project as required by AB 3185. The fee shall be $1,300 unless the project is found to De Dc Minimus (the project PAGE 2 OF RESOLUTION NO. 92-36 Bo has no potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends), in which case the fee shall be $25.00. If archeological materials are uncovered during any construction or pre-construction activities on the site, all earthwork within 100 feet of these materials shall be stopped, the Town Planning Division ntotified, and a professional archeologist, certified by the Society of California Archeology and/or the Society of Professional Archeology, shall be notified. Site work in this area shall not occur until the archeologist has had an opportunity to evaluate the significance of the find and to outline appropriate mitigation measures, if they are deemed necessary. All construction and grading operations, including delivery o:f materials and warming up of machinery, shall be limited to weekdays (Mondays through Fridays) during the hours from 7:30 a.m. to 5:30 p.m., unless otherwise approved in writing by the City Engineer. If determined necessary by the City Engineer, the project developer shall provide security fencing around the entire site during construction of the project. At least one week prior to commencement of grading, the applicant shall post the site and mail to the owners of property within 300 feet of the exterior boundary of the project site and to the homeowner associations of nearby residential projects that construction work will commence. The notice shall include a list of contract persons with name, title, phone number and area of responsibility. The person responsible for maintaining the list shall be included. The list shall be kept current at all times and shall consist of persons with authority to initiate corrective action in their area of responsibility. The names of individuals responsible for dust, noise and litter control shall be expressly identified in the notice. All Conditions of Approval for PUD 86-1 and SD 7035 shall remain in effect except as specifically mOdified by this approval. SITE PLANNING 1. No structures shall be allowed within an easement or required setback area. Rear yard accessory structures shall not exceed six feet in height and shall conform with the setbacks for accessory structures in the R-10 zoning district. PAGE 3 OF RESOLUTION NO. 92-36 C. LANDSCAPING Final Landscape and Irrigation Plans for the front yards of these units (with planting shown at 1"= 20' scale) shall be submitted for review and approval by the Planning Division prior to occupancy and the landscaping shall be installed within six months of occupancy. The plan shall include common names of all plant materials and shall indicate the size that: various plant materials will achieve within a five year period of time. All landscaping plans shall conform with the landscape requirements contained in Ordinance No. 91-14. o All rear yard landscaping shall be drought tolerant, non-turf, suitable to the climate of this region and require minimal water once established. All street trees shall be a minimum of 15 gallon container size and properly staked. o All existing trees on the site shall be preserved. Removal will be allowed only upon prior written approval from the Planning Division. 0 A stepped walkway system (eg. railroad ties or their equiwalent) shall be installed on one side of each downhill lot to provide access to the rear yard. The approved landscape plan for the orchard knoll shall be installed within the rainy season this Fall of 1992. ARCHITECTURE All HVAC ducts, meters, air conditioning and/or any other mechanical equipment whether on the structure or on the ground shall be effectively screened from view of the street or adjacent residences with ]landscaping or materials architecturally compatible with the main structure. The street number(s) of the building(s) shall be posted so as to be easily seen from the street at all times, day and night. Prior to the issuance of a building permit, samples of final colors and materials selected shall be submitted to the Planning Division for review and approval. The design of rear yard decks should be staggered by articulating their alignment while maintaining a minimum 20 foot setback. PAGE 4 OF RESOLUTION NO. 92-36 5. Trim boards shall be included on all side elevations at ground level. o In no case shall any structure exceed 2 1/2 stories or 28 feet measured from average grade. All downslope skirting and deck underpinnings shall only be utilized for storage, and not as habitable space. 'The maximum skirt height shall be six feet, unless approved by the Planning Division. The architecture for each custom home shall conform with the approved Custom Lot Design Guidelines for lots 29-42 and shall require Minor Development Plan approval by the Planning Division. The Planning Division may, at their discretion, refer the application to the Design Review Board for review and approval. One on-site subdivision sign is permitted per subdivision entrance. Since two subdivision signs are currently located on the site, the subdivision sign located on the knoll shall be removed as soon as possible prior to issuance of building permits in the development.
