HomeMy WebLinkAbout92-33 EXHIBIT A RESOLUTION NO. 92-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING AN INCREASE IN ENROI.IMENT FOR THE STRATEGIC TEACHING AND REINFORCEMENT SYSTEMS SCHOOL WHEREAS, Behavior Analysts, Inc. has requested approval of a Land Use Permit for an increase in enrollment from 12 to 18 children at the STARS school located on a 1.8 acre site; and WHEREAS, the subject site is located at 888 Podva Road and is identified as Assessor's Parcel Number 207-011-010-7; and WHEREAS, the Town of Danville M-12; Multiple Family Residential District Ordinance requires approval of a Land Use Permit; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on July 28, 1992; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves LUP 92-06 per the conditions contained herein, and makes the following findings in support of the Land Use Permit: 1. The proposed project is consistent with the Danville 2005 General Plan. 2. The proposed land use will not be detrimental to the to the health, safety, and general welfare of the Town. 3. The land use will not adversely affect the orderly development of property within the Town. PAGE 1 OF RESOLUTION NO. 92-33 The land use will not adversely affect the preservation of property values and the protection of the tax base within the Town. The land use will not create a nUisance and\or enforcement problem within the neighborhood or community. 6. The land use will not encourage marginal development within the neighborhood. 7. The land use will provide a valuable service for children with sPecial needs. Be There is no evidence before the Town that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. CONDITIONS OF APPROVAL '2. Except as may be modified by the conditions contained herein, development authorized by this land use permit shall be substantially as shown on the site plan labeled "S~ategic Teaching and Reinforcement Systems - Immanuel Lutheran Church", dated received by the Planning Division May 29, 1992. This permit allows the applicant to conduct classes in two rooms of the Immanuel Lutheran Church building. There shall not be more than 18 children at any one time and the ages of children shall not exceed 12 years old. Classroom times shall be limited to 9 a.m. to 2 p.m. Monday through Friday. Any change in the'~hours of operation or the organization conducting the classes shall be subject to review and approval under a separate Land Use Permit. The applicant shall pay any and all Town and other fees that the property may be subject to as a result of the development. These fees shall be based on the current fee schedule in effect at the time. Any change in the exterior building colors or materials shall match or be compatible (as determined by the Planning Division) with the existing building. The property shall be maintained in an attractive manner and all weeds and debris be routinely removed from the premise.
