HomeMy WebLinkAbout92-18 EXHIBIT A RESOLUTION NO. 92-18 A RESOLUTION OF THE PIakNNING COMMISSION OF THE TOWN OF DANVILLE APPROVING A LAND USE PERMIT REQUEST LUP 92-02 ALLOWING THE OPERATION OF A TEMPORARY CONTRACTOR'S YARD WHERF~S, Contra Costa Electric, Inc. has requested approval of a Land Use Permit to allow the temporary use of the site as a contractor's yard associated with Cal Tran's construction project on I 680; and WHEREAS, the subject site is located on the southeast corner of Sycamore Valley Road and Camino Ramon, at 800 Camino Ramon and is identified as Assessor's Parcel Number 207-021-010; and WHEREAS, a Land Use Permit approval is necessary to modify the uses allowed under the existing P-l; Planned Unit Development District for the site; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on May 26, 1992; and WHERF~S, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves the Land Use Permit LUP 92-02 per the conditions contained herein, and makes the following findings in support of the Land Use Permit: The proposed land uSe will not be detrimental to the to the health, safety, and general welfare of the Town. o The land use will not adversely affect the orderly development of property within the Town. The land use will not adversely affect the preservation of property values ana. thc protection of the tax base within the Town. The land use will not adversely affect the policy and goals as set by the General Plan. CONDITIONS OF APPROVAL (Note: * Indicates standard proiect Conditions of Approval)~ Unless otherwise specified, the following Conditions shall be complied with within one month of approval of the project. Each item is subject to review and approval by the Planning Division unless otherwise specified. This approval allows the operation of a temporary contractor's yard on the site, including three construction trailers, construction vehicles and equipment, and the storage of construction materials. The site is identified as the southeast corner of Camino Tassajara and Camino Ramon (APN: 207- 021-010. (tie in level of use -# of vehicles etc. ?) This Land Use Permit shall be valid for a period of approximately 18 months, ending on December 31, 1993. A new six foot wood fence shall be constructed along the Camino Ramon and Sycamore Valley frontage of the property. The exact location and design of the fence shall be submitted for approval by the Town Design Review Board. The applicant shall prepare a landscape plan for the site. The plan shall include the placing of 48 inch box size trees along the properties Camino Ramon and Sycamore Valley Road frontages, and in front of the storage trailers. The ifltent of the trees is to help screen the site from view from Sycamore Valley Road and Camino Ramon. The trees shall be of an evergreen variety to provide year-round screening and be large enough to provide immediate and affective screening. The exact locations, number and species of trees shall be submitted for review and approval by the Town's Design Review Board. The applicant-shall install a temporary asphalt sidewalk, and repair the existing AC berm where necessary, along this properties Camino Ramon frontage. Width of the sidewalk shall be consistent with the concrete sidewalk fronting Navelet's. This work shall be completed concurrently with the Town's installation of a "No Parking" sign along this frontage. The location of access ,to the site shall be as far away from the Sycamore Valley Road intersection as possible, subject to review by the Town's Engineering Division. 0 10. 11. 12. 15. All areas on the site, within 50 feet of the proposed access point from Camino Ramon, shall be improved with a rock base material. In addition, all areas where construction equipment is stored and employee's cars are parked, shall be improved with a rock base material. Existing tall grass and weeds on the site and adjacent to the site shall be cut. Grass areas on the site and adjacent to the site shall be maintained in a cut condition. Within 30 days after the expiration of this permit and the termination of the use, the site shall be cleaned-up to the satisfaction of the Planning Division. Clean-up shall include all materials and equipment, the required new cyclone fence, all debris and, if determined necessary by the City Engineer, the required rock base material. Within one month of approval of this permit, a $2,500.00 certificate of deposit, or other security acceptable to the Chief of Planning, shall be submitted to the Planning Division to assure clean-up of 'th~ site. The deposit will be refunded upon clean-up to the satisfaction of the Planning Division. The maximum stacking height of all materials stored on the site shall be six feet. The operation shall meet all requirements of the San Ramon Valley Fire Protection District. Within 10 days after project approval, the applicant shall submit to the Town of Danville fees required to file a Notice of Determination for this project as required by AB 3185. The fee shall be $25.00. Proposed security' lighting shall be low level, directed on-site, and shall not shine into adjacent properties or cause a nuisance for passing motorists. A maximum of two light poles, located in the interior area of the site, are approved as part of this permit. The existing, as of yet non-operational, lights on the site,, located on two light poles, shall be shielded so that the light source is not visible from off-site. The intensity of the lights shall be subject to review and approval by the Planning Division. The developer shall obtain an encroachment permit from the Engineering Depat:U~ent prior to commencing any construction activities within any public right-of-way or easement. The developer shall keep adjoining public streets free and clean of proiect dirt, mud, materials and debris during the construction period, as is found necessary by the City Engineer. 15. Any damage to street improvements now existing or done during operation of the use on or adjacent to the subject property shall be repaired to the satisfaction of the City Engineer at full expense to the operator. This shall include slurry seal, overlay or street reconstruction if deemed warranted by the City Engineer. 16. A revised site plan for the use shall be submitted for review and approval by the Town's Design Review Board. The plan shall provide for the more efficient placement of the storage trailers, materials, construction vehicles and equipment, and employee parking. Activities that generate noise should be located as far to the west, away from the residential areas to the east, as possible. Circulation within the site should be organized to minimize backing-up of vehicles. 17. All signage associated with this use shall comply with the Town's Sign Ordinance. 18. No backing-up of equipment which generates excessive noise shall occur during the ho~rs, between 4:00 p.m and 7:00 a.m. If the Town receives complaints of persistent noise being generated by the use during these nighttime hours, the use shall be scheduled for re-consideration and possible revokation by the Planning Commission.
