HomeMy WebLinkAbout92-14 EXHIBIT A RESOLUTION NO. 92-14 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING A .ONE YEAR EXTENSION OF TENTATIVE MAP MS 21-89 - PIERCE (APN: 206-170-011) WHEREAS, Charles and Lana Pierce have requested approval of a one year extension of previously approved Tentative Map MS 21-89, a two-lot Minor Subdivision on 10.0 +/- acre site; and WHEREAS, the subject site is located at 1625 Lawrence Road and is identified as Assessor's Parcel Number 206-170-011; and WHEREAS, the Tentative Map for the two-lot Minor Subdivision was originally approved by Contra Costa County in September of 1989; and WHEREAS, the area was annexed into the Town of Danville in April of 1991; and WHEREAS, the Town of Danville Subdivision Ordinance and the State Subdivision Map Act allow for up to three one-year extensions of a Tentative Map; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on April 28, 1992; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves the one-year extension of Tentative Map MS 21-89, and makes the following findings in support of the Tentative Map extension: PAGE 1 OF RESOLUTION NO. 92-14 The proposed subdivision is in substantial conformance with the goals and policies of the General Plan. The design of the proposed subdivision is in substantial conformance with the applicable zoning regulations. o The design of the subdivision and the type of assodated improvements will not likely cause serious public health problems. The density of the subdivision is physically suitable for the proposed density of development. The design of the proposed subdivision and improvements are not likely to cause substantial environmental damage or subsequently injure fish or wildlife or their habitat since this property is in an area where residential development has previously occurred. The design of the proposed subdivision and proposed improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. o As conditioned, the Minor Subdivision will not be injurious to public health, safety, or general welfare, or be inconsistent with existing Town ordinances or polities.
